Euro Car Parks PCN for using Blue Badge

Hello,
First, thank you for providing this valuable collection of information on parking notices - I've read the newbie section and hopefully this post is in order.  However, if not, please accept my apologies in advance.
I parked in a private car park at a Catholic Church which is available to the public on a ticketed basis.  I had my disabled mother with me at the time and used her blue badge to park our car.  We parked in a regular spot not a designated disabled spot.
I since received a parking notice based on CCTV capture of my number plate because I did not display a valid pay and display ticket.
I assumed I didn't have to pay because of the blue badge.
Have I made a costly mistake and is there any prospect of avoiding the reduced £60 charge (will be £100 if not paid by 5 Mat 2021).
The ticket was issued by Euro Car Parks.
Thank you in advance for any help.

Your assumption was and is incorrect , as it will always be

A blue badge does not guarantee free parking , anywhere , the signage defines it , especially on private property or council car parks

ALWAYS read the signs , especially in private car parks , as a Driver you are expected to comply with all signs , on and off roads , otherwise it's described as driving without due care and attention

To win this you would have to win on a technicality , you haven't given enough information to decide any reply !

A complaint to the landowner may work , plan A in the newbies FAQ sticky thread near the top of the forum

Did ECP comply with POFA ?? Yes or no ?

A CCTV would not determine whether a blue badge was displayed. ECP use ANPR cameras to capture your VRM, after which they do a match with VRMs entered in their Pay and Display machine when purchasing a ticket.  CCTV has not been employed.

This is nothing to do with a blue badge, which is largely irrelevant on a private car park in relation to payment - everyone has to pay.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Why do people do that?  Makes no sense, a BB is not means tested and on private land, contract law applies.

Have I made a costly mistake
No, because you won't be paying the thing.  You need to read the NEWBIES thread and appeal as shown.

Most APCOA car parks are free for blue badge holders if you apply t them for a permit. You then register you car and the number plate is recognised for free parking. See https://bluebadge.apcoa.co.uk/

That is terrible. Appalling that they can't be bothered to pay people to check disabled bays on foot. They cheaply operate using ANPR and then issue PCNs to disabled people who would have NO IDEA about the above.

If you ever come to Devon you will find that virtually all car parks including council ones charge blue badge holders for parking, I don't know where this urban myth has come from that BB holders get free parking everywhere, it certainly does not say that in the booklet does it?

Apart from some Sunday or bank holiday exceptions, its the same in greater Manchester, you pay regardless, but get an extra hour

Anything that is free tends to have limits these days typically no more than 4 hours but usually a lot less

With this caveat or is it a trap, either way on site signage still needs to be studied:
Please be advised that not all APCOA locations offer free Blue Badge parking, please check www.apcoa.co.uk or local signage to confirm if tariffs apply before parking.

Is this a joke? You can park anywhere in the car park, not just disabled bays. And if you read the signs (even if disabled you can take a little responsibility) you see the process. If it easy to apply and I got approval overnight.

Come live in Brighton. You don't pay in Council spaces, can park on double yellow lines if not blocking traffic.

Correct - not everywhere, but in most. Free parking at the station car park is very useful.
