Because I do not have your undoubted knowledge and experience of international legal matters! To me it sounded better and more understandable. However, I have just referred to my Funk and Wagnalls and discovered that you are right in that: -D_P_Dance said:I wonder why you have altered Shall to will. I am aware that, in International Agreements, shall is mandatory, and will is not, but is there another reason/?'Will' when used in the first person, conveys an obligation, whereas 'shall' merely a future intention. Conversely, when used in the second or third person, 'will' conveys a future obligation, whilst 'shall' imports compulsion and obligationJust something else to add to my pursuit of ridding the world of split infinitives, less vs fewer and not starting a sentence with a conjunction like "so".2 -
Good point... i'll remember that for next time.Redx said:That last sentence is fiction , because pcm UK are IPC AOS members , not BPA AOS members

Hello,
As predicted my appeal has been rejected by PCM UK Ltd. My understanding from the newbie thread is that it's not worth IAS appeal as it will likely be rejected - the only hope is the NTK/PoFA argument which toiletduck had success with. My issue is that the rejection letter I have received is dated 29th April and it states an appeal with IAS should be submitted 21days from rejection, so if i were to appeal today it would have past the 21days.Can anyone advise if it would still be worth me appealing or should i hurry up and wait for the small claims court?
Thanks in advance1 -
My understanding from the newbie thread is that it's not worth IAS appeal as it will likely be rejected - the only hope is the NTK/PoFA argument which toiletduck had success with.Ordinarily we advise not to proceed with an IAS appeal. However, Covid has had at least one positive effect in the shape of furloughed car parking staff, with fewer of them available to put together their evidence and statements to rebut an IAS appeal. Consequently an unusual number of IAS cases are withering on the vine, and of extra special note is that PCM UK are the worst (or is that best?) offender as we've seen more 'no shows' from them than any of the other bunch. While your NtK/PoFA point will be a useful appeal point, you will need as many as possible, enough to make PCM's eyes pop and for them to throw in the towel. Plenty of photos, lots of verbiage, lots of everything you can throw at them. Please look at some PCM threads from the past few months and in particular check out those that have succeeded at the IAS, but I'm sure there will be useful ideas in most of them.In addition, read the NEWBIES FAQ sticky, third post, which provides a number of near-template appeal points which you can adapt. While they are generally targeted at POPLA appeals, they still have applicability for use in IAS cases - just adjust any sentence that is obviously POPLA-focused.Don't lose heart, lots to go at, if even only to cause (and cost) PCM UK some heartache. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
