Help with N244 form

Morning all,

Apologies if the information is on the forum elsewhere... I have looked but cannot find the answers to my questions...

1) when filling out the N244 form for a set aside, which court do I ask to send the form to? Is it my local court or is it the Northampton Business CC where the Ccj  was registered?

2) how do I pay the £255 court fee? Who is it payable to?

3) do I need to have made contact with Civil Enforcement Limited before asking for a set aside? The CCJ was logged in 2017 and I only learnt of this a month ago.

Thanks

The set aside advice is detailed in the NEWBIES FAQ sticky, second post.  You should also do a search on advice given by @henrik777, who is the forum set aside expert. Once you have the basic knowledge the forum will help you further, but there isn't the resource to lead every set aside thread (and there are dozens every month) from first base each time.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • I should have made it clearer that I've read the NEWBIES thread already, but cannot find the answers to my questions. I've also been on the phone to the Citizens Advice Bureau this morning, and the gentleman I spoke to also didn't know how to help me.

    Umkomaas, thank you for posting.

Waiting for a good samaritan to help me.

Here's an idea - phone your local county court and ask them if they will accept it. I am sure they will. There is no point in it being sent to the CCBC for them to simply forward it to your local court.

Please stop trying that.  They are utterly hopeless about anything to do with private parking.

Either.  If you send it to the CCBC they will allocate it out anyway.  But if you take it to your local court they might send it round in a circle via the CCBC!

    2) how do I pay the £255 court fee? Who is it payable to?
You ring and pay it by card to the court, just after emailing your set aside and witness statement/draft order to them.

    3) do I need to have made contact with Civil Enforcement Limited before asking for a set aside? The CCJ was logged in 2017 and I only learnt of this a month ago.
You should do but DO NOT DELAY beyond a week, AND DO NOT AGREE TO PAY THE CCJ SUM OR PCN SUM TO CEL.  That is what they will suggest!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • I also need the same help as the original poster.  Which court do I ring to pay the CCJ?  Really confused.  TIA x

That doesn't sound like the same problem the OP has. The OP was looking to set aside a Judgment.

@Shoegal2, it's probably best that you start your own thread as trying to deal with the issues of of two people in one thread can only lead to confusion.

You don’t PAY a CCJ to a parking firm!  That does NOT remove it unless the judgment is less than 30 days old.

you need to read the set aside a CCJ section of the NEWBIES thread, top of this forum. No link given and don’t use a phone...
