ULEZ - did not receive letter of rejection - missed chance to appeal

I'm writing on behalf of a friend.  Long story short, he has been issued a PCN (or whatever) for the London ULEZ.  It has progressed to him being sent a "Notice of Rejection" (NoR), which gave him 14 days to pay the £80 reduced rate, or 28 days to appeal. He did not receive the NoR.  My friend only knows that he missed the NoR because he called them to see why he'd not heard from them after a month or two of no news. 

By missing the NoR he missed the chance appeal and missed the chance to pay the reduced fee.

He has written to them to say that he didn't receive this NoR but they seem to have ignored this and just state that he must pay the full amount now. 

Can they just assume he must have received the NoR and ignore the possibility that he did not receive it?  Is there anything he can do to be given a fair opportunity to pay the reduced fee or appeal?

    How did it progress?  What happened between him driving in the ULEZ and them sending the NoR?  Did he appeal when he got the initial penalty and that was rejected?  If so, then I expect the 14 day offer was outlined in the original notice, so having appealed he should have considered whether it would still apply.

    It sounds as if he's been a bit lax.  He got caught, appealed and then didn't follow it up "after a month or two".  As I understand it the offer of reduced payment is discretionary.  If he's missed the window, that's it.
  • What happened between him driving in the ULEZ and them sending the NoR?
    - He told them that he was Euro 6 compliant (he thought he was as he drives a taxi and it was a requirement for his local taxi licence)
    - They asked for proof (v5 etc)
    - He sent V5 (Euro 6 it is not stated on the v5, but all the emission data is stated) 

    I think it is at this point that he should have received the NoR.   I don't think he's being lax especially

    No, because he didnt receive the Notice of Rejection (NoR) and hence didnt know the status of what action was necessary. This is his problem - not receiving the NoR document meant he couldn't appeal or pay the reduced fee.
