Help with debt

Looking for some advice please.

I have a default from NatWest for just short of 2k. This was from years ago, it no longer shows on my credit report.

I’m being contacted by Cabot, they send me letters which I tend to ignore, I know this is not good. The letter now says someone will be calling to my house to discuss a plan.

I’m in the middle of a mortgage application so need advice on how to go about sorting out a repayment.

I could offer a part settlement or set up a plan, I’m sure I can do this online, but by doing this will it reappear on my credit report?

Grateful for any advice.

    No.

    But is it statute barred?
  • I don’t know 🙈 is that when it’s over 6 years old? I really don’t know when I last had contact with anyone about this debt. It’s been passed round various companies over the years.

Only payment or written acknowledgement counts, so if you have not paid this, or written to the creditor to discuss the debt, for any period of six years, and as its gone from your credit report, its pretty safe to assume the debt will be statute barred.

You should send a letter to Cabot stating the above, and get them to do the donkey work proving it isn`t.

It sounds like Cabot have purchased a junk debt and are trying their luck with you trying to get money out of you.

If it is off your report I would think it's statute bared so I wouldn't worry.

If you decided to pay and offered a part settlement, this would probably get put onto you report and reflect this.... so I would avoid this option.

The threat of "Someone will show up at your house" is a normal tatic that these kind of companies use to try and intimidate people.

Personally, as you have been ignoring all correspondence for years, I would just go on doing so.

Once gone from your file, nothing, repeat nothing you do, can bring it back again.

  • Thank you everyone who has offered advise.

Ive found a letter on National Debtline to get them to prove to me that I still owe it, I’m sending it today.

As I said previously I have just received a mortgage offer as we are moving house so I really don’t need a CCJ at this point 🙈 could this letter push them towards a CCJ if say I’m close to the 6 years? What would the process be? Would I get a last chance to pay or were taking you to court,  or would it just happen and I’ve a CCJ?

I have ignored it for years, and if it wasn’t for the mortgage pending I’d be much more relaxed about it but I really cannot jeopardise the house move. I was on the brink of just paying it this morning but you’ve given me confidence to try to sort it out 😃

You can’t just get a ccj. There is a process they have to follow. You would get a letter before action.

Send the statute barred letter as stated above
  • As we’re moving house I’ve a massive box of crap for shredding, I’ve just had a poke through to see if I can find any old letters.

I’ve found one from Moorcroft, I must have made a payment via phone on 3.12.15, the balance was £2894 and it’s now £1994 so I must have made payments following this.

So I guess it’s not statute barred and the question is how to proceed so as not to put my mortgage offer at risk. We’ve had our offer but I’ve heard sometimes they do a check before completion. In that case would it be better to offer a settlement??

Although it’s not turned out as I was hoping I really thank you all for your advice as it’s helped me understand what was going on.

You've sent a prove-it letter - see what comes back.

    One stage at a time.

It's off your credit file and staying that way so it's not going to have an effect on your credit file
