To explain the situation. I am making a complaint against our conveyancer that we used when we moved home this was back in 2019 so no Covid delays.
The solicitor used a third party to do the searches which took over 10 weeks to come back. I asked them many times the date that the searches were ordered but they would not tell me. Due now to Covid there's been a delay in The Ombudsman involvement as there is quite a few issues that I wish to complain about which I have evidence to support. However I cannot prove that they forgot to order my searches which is what I firmly think is the case.
I have contacted the search company and they shall not give me the date as I am not the solicitor.
I was wondering if I had a 'right' to send a SAR to the search company asking for this information? or do I not have that right as I paid the solicitor and they paid them. The only information im needing is the date that the solicitor ordered my searches. Thanks in advance for any help offered.

I don't know whether the search company would recognise who you were i.e. whether your details would have been on the search request. You are however entitled to a copy of your conveyancer's file.
  • What are you hoping to achieve by your complaint? I'm presuming you have a figure in your head.
Is it really worth continuing this after 2 years?

No, you do no, you were not the subject. The searches are on a property, about a property.

As David has mentioned you are entitled to a copy of you file from the conveyancing solicitor.

Also in addition to Rogue's post, you would need to demonstrate a provable loss that was caused by their delay, a delay that was not covered by their contract and that it was a proper, provable loss, not just your opinion. However it is highly likely that the contract protects them from this.

In short, you are wasting your time, let it go.

What is the underlying complaint about?  How is the date of searches going to help?
