The only reason they ask about witnesses is so they can allocate a room big enough; you are not a witness, you are the defendant. Driver does not need to be there. Anyway, it is likely to be a telephone hearing isn't it?2

I am not the defendant,as I made the mistake of not changing it to my name in time. The registered keeper is under a family members name so he's the defendant however I'm the one helping him. Will I be allowed to speak for him if it goes to a local hearing in this case? Or would it better to put myself down as a witness

You can be a lay rep but you will need to make this clear later on in the process. Just complete the DQ (N180) and don't miss the deadline for that. Once that is done you will have time to search the forum for advice on what to do if you want to be a lay rep. When it was F2F hearings you just turned up and told the clerk before the hearing started. Good to have a copy of the rights of audience under your arm. Nowadays with it likely to be telephone or video, it is recommended to advise the court (once it is known) because you will have to provide two telephone numbers, one for the defendant and one for you.newbie772 said:

There is ONE witness = the Defendant.
You are a lay rep and not a witness. You can certainly speak for the Defendant as a lay rep on the day and need no prior permission as long as the D also attends the phone hearing with you.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi everyone, we received a letter from DCB legal with a copy of our completed DQ. It mentions to 'revisit the directions within the document as it was not correct to send the DQ to them directly'. I have realized we sent the DQ forms both by email to the
CCBCAQ@justice.gov.uk and directly to the First Parking email address.
Is this a mistake? as now on the MCOL website it says general sanction orders were made today

Your County Court Claim Form has a box labelled Address for sending documents and payments.
If DCBLegal are acting on behalf of the Claimant, it is to them that you should've sent a copy of your completed DQ.
No idea what sanctions orders have been made. Why don't you ring the CCBC and ask them?3 -

I received a letter from the CCBC saying I failed to file the DQ. I've checked the email and it definitely was sent, however there was no acknowledgement. I shall resend the the DQ form by email today and ring them up tomorrow if I don't get an acknowledgment. Will I need to send the DQ to DCB Legal as well. DCB already sent me a letter as mentioned with the DQ attached

You send anything you send to the court to the claimant's solicitors too.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
