Online stores selling items they do not have in stock

I wonder if anyone else has found this problem with online retailers advertising technology products (laptops etc) and allowing you to order and pay for them before telling you that they do not have the item in stock plus have no firm delivery dates. To make matters worse you then have to chase them to get your money back. I would class that as bordering on fraud as they are offering goods which they do not have available. Anyone had similar experiences?

    It has been going on for years.  It used to be rife on ebay.

  • The specific business in this case was Currys PC World Business. I would expect dodgy behaviour like this on ebay but when a large company website shows "10+ in stock" you assume that they are telling the truth.

    In which case, it's not a consumer rights matter.  Why not just buy from a supplier where up-front payment isn't required?
  • Sounds like their supplier has them listed, but there's just no stock when the order has been sent for fulfilment. 
    Poor stock control rather than fraud, but annoying nonetheless! 
    Fraud is all about the intention - they did intend to provide the goods, so it's by definition not fraud.

    Worse than this Marks Electrical have done this to me with a TV
    They have a promotion with Amex for 10% cashback  off but have taken my money 4 weeks ago, promised it would be with me in 14 business days but now say they have no idea when it will arrive.
    I was happy to share my experiences with Amex about how Marks are treating Amex customers

    Some businesses do not carry a great deal of stock on certain items . It comes from the manufacturer direct .

    For various reasons (Suez, Brexit etc) there are many items that are not in stock.  Try buying a lawnmower just now.
