    Is the house in your name as well? you didn't answer this question.

    You'd need to dispose of your share of the property to him - with potential capital gains liability depending on how much the property is worth.

    Whats more, however the property is held, then the income from the property needs to be split in the same proportion. In other words, if you own 50% of the property each then 50% of the rental income is legally yours for tax & UC purposes - even if he keeps it all you must declare whatever your share of it should be.

    If your name is currently on the deeds then you do still have capital in the property. If you transfer your share into his name without proper compensation, then that is deprivation of assets.
    I repeat, you cannot give away a property share just by a verbal agreement with your ex. Yes, you can agree to give it away at some future date, but until the ownership is transferred at the LR, it remains (partially) yours.
    It seems quite clear why your UC has been stopped. 
    No free lunch, and no free laptop ;)

    You cannot just say the property belongs to someone else to get benefits.

    You need to legally transfer the property to your ex partner  and ,  as said above, there my be CapitaL Gains Tax due. 

     If there is a mortgage in both names then you need to advise the lender  of the transfer of ownership  as the mortgage will be affected.

    Until you sort that out you will not be eligible for UC.

    Once it is all dome properly you will have the necessary documents to give to UC to reassess your claim.

    The agreement is that I live in the house and my partner has the flat. I am no longer benefiting from the flat and have no capital in there as we have split the properties as I've described. The house is mine and I live in it. This was the decision we reached. We are in the process of sorting out the paperwork in terms of deeds and mortgage. In the meantime I need to claim benefits as my work stopped due to CV so I have money for me and my daughter to live off. I appreciate that this may not be conventional but this is the situation I am in.

    I would prefer not to claim any benefits at all but I am a sole trader and have not been allowed to work since October. Because my business was less than a year old I was not able to claim the grant. The Governent has left a large gap here for people in positions like myself.

    Until everything is done correctly (legally) then you won't be able to claim UC if there's equity in the house.  You should have declared the property when you first claimed it again and not doing so is fraud. It's clear why your UC has been suspended.
  • You should also expect to have to repay the Universal Credit you received for the period when you failed to declare your ownership of the flat.
