Only Half Purchase Price Refunded

I bought a Majority internet radio in April 2019.  It came with a three year extended warranty which took effect when I registered the product with the manufacturer.  Just over a year later the radio stopped working and kept trying to reset itself.  I emailed Majority and waited months but never received a reply.  I then asked for either a replacement or a refund. 

First, Majority claimed they had no record of my registering the product but luckily enough, I had saved the email and was able to send them proof of registration.  I was then offered an ‘open box’ replacement.  I replied that I would only accept this if it came with a one year warranty and they covered the p&p.  They have now refunded me with half of the original purchase price.  When I queried this they said this was because I had already enjoyed the benefit of the product.  Surely this can’t be a valid reason for not giving me a full refund?  I would expect a radio to last a lot longer that a just over a year.  I have pasted their reply below.  In this, they mention ‘a few possible options’ but only list one.

 

We have identified a few possible options for you, all in accordance with the Consumer Rights Act 2015. As it stands, these are the only options available to you:

1) You keep the item as is, and we issue a partial refund of 50% of the original total value.

Additional clarification:

- Regarding Option 1, 50% is the maximum refund possible. In accordance with the Consumer Rights Act 2015, deductions from the total value are to be made in relation to the length of time you'd had use of the product.

Finally, please also be aware that what we have offered in this email is only possible as long as your warranty is valid. Once your warranty expires, then you'll no longer be eligible for any of the options stipulated.

Please simply respond to this email, clearly specifying which of the above-mentioned options you would like to proceed with.

    Warranty is not the law/your Consumer Rights .
    No right under warranty for any refund .
    Under Consumer Rights against the vendor  they have the right to choose to repair replace or refund .
    Refund is subject to a deduction for usage .

    It's a shame that Majority don't know that, since they completely confuse the two in their response.
