If the roads don't get adopted, is there some agreement in place for their maintenance?

As an update I received the below from the council, I believe this would satisfy the second point in my solicitors enquiry, what information would be needed along with this as he requested the road/bond agreement - would it be copies of the Advance Payment Code Notice and/or the Deed of Guarantee

According to our records, an Advance Payment Code Notice covering the above mentioned property has been served and satisfied by a Deed of Guarantee. The Deed of Guarantee has since been reduced from £749,654.00 to £374,827.00 to reflect the works that have been undertaken to the roads.
Please be advised that there is currently no Section 38 Agreement in place.
