Lease company recall

I agree with your comments. Yes it has been serviced and MOTd, which is all upto date. The problem I have is that my local dealership are fully booked till end of August and, at this stage, are taking names and numbers because they do not know when delivery of the recall part will arrive. By the time they contact me to book the car in it should be back with the lease company by then. The lease company are arguing that they cannot take the car back until the recall fix is complete but that could take many many months. Which means many months stuck with a car that I don't want/need and I have another lease car on the way in May.m0bov said:Check T and C, if its MOTed and Serviced and the recall is booked, that's all you can do. As above, tell them it will be ready for collection on the agreed day and that's it.
A recall is not a warranty issue, if its not safe to drive, you would have a courtesy car.0 -
Does the T and C mention a recall? You lease would have ended so its for them to deal with. You can ask them where they want the car stored as it won't be insured. Its not even your car, its owned by the lease company!0

Thank you for this. These were my thoughts too but I didn't know where I stood legally with it all.m0bov said:Does the T and C mention a recall? The only part of the contract that mentions recall is in the 'my obligations' section...
- the vehicle complies with any manufacturer's recall notice and at your own expense, arrange for such alterations or modifications to the vehicle as may be required by any law or regulation which comes into effect at any time after the delivery of the vehicle.0 -
Well, you have it on the waiting list. If they still push the case, then you will be claiming for storage fees and any other expenses as the car is not roadworthy with a safety defect. Let us know how you get on.0

P.S Do you have any legal cover with your insurance or household insurance?0

Of course it's roadworthy. There is no issue with the ABS or ESC. All there is is the slight possibility that the wiring may chafe and short. If that happens, the ABS and ESC will fail-safe, turn off, and put the warning light on.m0bov said:...as the car is not roadworthy with a safety defect.
If that does happen, then there will be zero difference in the vehicle unless and until it's driven in such a manner that grip would be lost either in cornering or braking. Then it'll behave the same as any of the millions of vehicles without ABS or ESC.1 -
Is there another dealership a bit further away we got the recall letter and phoned the number on the letter and we’re given a choice of dates and dealerships in our area we only had to wait a week and got it sorted straight away . We live near Wakefield but had it dine in Barnsley0
