Restocking fee

I went to a reputable mobility dealer, tried and liked a second hand, low mileage mobility scooter for 2000. The receipt stated 2333 and a discount of 333 as a trade in was given. I've found some faults to do with steering but was told I could return it for a day, next Monday,  for tracking adjustment. I have since found that I could buy a brand new same item from importer/supplier for less than 2000. i wish to return scooter but I'm told a restocking fee of 100 would be payable. Is this correct? Can I be charged this within 3 days of delivery on a machine delivered faulty? I'm guessing i wouldn't get old one back as he had written it off as too expensive to repair.

    If you've already agreed to the repair then you need to allow them the opportunity to do so. If the repair cannot be carried out without causing significant inconvenience or cannot be carried out within a reasonable time or the retail repairs the goods and they still don't conform you would be able to reject for a full refund. 

    Ignore the cheaper price. It's irrelevant to your consumer rights. 

    This is also assuming you didn't purchase at a distance (not face to face at any point).

    If it's faulty then you can simply reject it for a refund and buy elsewhere.  The trade-in might complicate the money a little if they've since scrapped or sold on the scooter you traded in, but that's a marginal thing.
