Selling a house with breach of planning condition

hello there, just after some advice really. Nearing the end of conveyancing process, selling our house which is a new build - built in 2011. Just come to light that the independent developer has breached a condition of planning when it was granted for the build, saying that he should not connect the surface water drainage to the public system, and use a soakaway instead. Turns out, the surface water is connected to the public system. The house has been connected up now since 2011, which is about ten years. No problems or enforcement issues etc. House has all building regs and completion certs, and a house warranty etc. 

Do you reckon this will affect the conveyancing process? Offered to our solicitor that we would be happy to take out indemnity policy etc. 

Slightly worried now....!

    There are instances this can be allowed but there’s a process to follow. 

    We had a building inspector who advised we remove a soak away and run it into a public system due to a wall being built on the boundary.

    Worth looking it up as there’s actually a small charge to do it to the water company and it has to be a last resort to clear the water.

    Has the solicitor advised any potential solutions?
