Packaged Bank Charges

2 Posts

Hi, we are trying to claim back charges on a packaged bank account my husband had. Halifax has now come back to say that it's too late as after 6 years since he had account. I think we closed it around 7 years ago. Is this worth pursuing? Would really appreciate some help as I am paying off debt and looking at every option we have.
Thank you.
Thank you.

move on with your life, there’s nothing more doing here.
it's spelt d-e-f-i-n-i-t-e-l-y
there - 'in or at that place'
their - 'owned by them'
they're - 'they are'
it's bought not brought (i just bought my chicken a suit from that new shop for £6.34)
You cannot pursue it as you can't argue that 7 years ago is less than 6 years ago.
The timebar rules are similar to that in law. You must complain within 6 years of the purchase/event or 3 years from being reasonably aware of an issue. Both rules need to be met to comply.
You say it was closed 7 years ago. So, that means it was opened more than 6 years ago and meets the 6 year timebar rule. Closing an account is enough to start the 3 year clock. That was 7 years ago. So, that rule is met too. Both rules met = timebar allowed.
Could you break it up a little or bullet point it?
punctuation - not even once.

My reading of your post is that you opened an account 10 years ago (so fails the 6 year time bar rule). If you have documentary proof that you complained 10 years ago then send a copy to them e.g. the letter you wrote or email you sent. My suspicion is that you simply talked to someone in branch or on the phone and never made a formal complaint. As such you also fail the 3 year time bar rule.
If you look at it from an outsider's perspective, you had an account for 9 years that you were really unhappy with yet never formally complained about until last year? That looks like you are simply jumping on the bandwagon and wanted some free cash. A complaint would hold more weight if you complained much sooner.
Regardless, if the time bar is correctly applied then your case is over.
