New Kitchen - Fitter not returned refund money

    Sorry to be pedantic, but (1) did you make one single payment to the fitter to include both the purchase and fitting of the kitchen, or (2) did you buy the kitchen from the supplier in one transaction, and pay the fitter separately for the fitting?

      The OP had also already purchased a tap for the kitchen, but the fitter, presumably, used the one that came with the delivery. - No he fitted the tap I purchased. He got credited into his account £300 when he returned the tap that came in the delivery.

    Due to the fitter not willing to show me the invoice for the kitchen which he had ordered, I still do not know how much the kitchen actually cost. Had I been able to view the invoice I would of seen the tap and the glass splashback had been ordered and other extra items. I feel the fitter planned it this way so he could easily make money out of the returns without me knowing about it. All this only came to light due to me finding the delivery note an noticing items had been ordered and not installed. The delivery note is the only document I have of what was ordered and delivered to my home. The Delivery note does not give prices and the kitchen company won't give me this information stating I have to go through the fitter. The fitter stated recently that he always works this way, he always orders extra items to ensure the installation goes to plan. Plus, due to this 'flaw' the kitchen company know what is happening and doing nothing about it. Morally, the fitter should pay me back for the tap and splashback, but he won't because he is a crook. Amen

    Just wondering who the supplier is? I'm thinking it could be Trade Only.. Like Howdens? If it's not then I cannot understand why you would not have just paid for the kitchen directly?

    At the end of the day did you pay the fitter/howdens the price quoted  for the kitchen and did you pay the fitter the price quoted for fitting. I think I already asked that but sorry I am still confused.

    I assume you knew that Howdens only sell to the trade ?

    But not all the units were bought by the fitter.  The OP themselves bought and paid for a splashback and a tap.

    The OP has in effect bought and paid for two splashbacks (the first the original one from Howden's via the fitter, and the second from a different supplier) but has only had one (the second one) installed in their kitchen.  The OP thinks - and I agree with them - that they ought either to have the first splashback still sitting in their garage, or they ought to have some money in their bank account representing it.  But the fitter has taken it away and got a refund on it - which ought to belong to the OP.

    A similar argument applies to the tap.  The OP already had a tap that they had purchased previously.  The fitter fitted the tap that came as part of the purchase of kit from Howden's and did not use the tap pre-bought by the OP.  But for some reason the fitter decided that he had the "right" to appropriate the OP's tap and get a refund for it.  Again, either the OP ought still to have the tap in their possession or they ought to have the refund value.

    I will admit I do not understand how the fitter managed to get a refund for the splashback from Howden's when the OP says they bought it from a different supplier.  If the fitter got a refund from the supplier the OP paid and bought it from - I would say that sounds decidedly dodgy.

    The OP paid for a kitchen to be supplied and fitted.

    The OP then bought an additional splashback and tap (and something else?) from elsewhere which the fitter installed instead of the original one.

    The fitter then took the original splashback and tap and other item(s) away and got a refund for them which he kept. These items did not belong to the fitter. They should have been left in the OPs garage for the OP to sell on.

    So the OP is legally entitled to the items he paid for back or an equivalent redund.

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)
  • Agreed.  It's no different from the fitter choosing something at random from the OP's garage and nicking it.  I'm surprised so many posters think the OP isn't entitled to the return of the items or a refund of their cost to him.

    As the OP did not pay for the items in question then  I cannot see how they claim to own them.
