URGENT - Excel parking Services Limited - parking fine £160!! please help.

Please help, 

My husband is an employed plumber and was working in the same location 4 days out of 8. He paid all times to park, on his 3rd day he went through the online process to pay for £4.20 for the day. It went through but he noticed after several hours he had not received the usual virtual receipt.  As my husband noticed this during his liunch break, he immediately went back to the payment page and paid again. It was being covered by his employer so why wouldn't he! 

Once back at his van at the end of day he had received a parking fine. 
He has just  received a letter from ELMS legal advising they are acting for Excel Parking Services Limited stating they will be taking him to court for £160!!! 

Please help, we are getting very panicked by the solicitor letter.

    This can only be settled in civil court , nothing you can do to avoid it , assuming that he is refusing to pay , as you would

    Nothing urgent at all , nothing to be done right now , apart from him emailing a SAR to the DPO at Excel

    Ps , as a plumber , if he issued an invoice for work done and it wasn't paid , he would do the exact same thing , within 6 years

    Excel v Wilkinson

    At the Bradford County Court, District Judge Claire Jackson (now HHJ Jackson, a Specialist Civil Circuit Judge) decided to hear a 'test case' a few months ago, where £60 had been added to a parking charge despite Judges up and down the country repeatedly disallowing that sum and warning parking firms not to waste court time with such spurious claims.   That case was Excel v Wilkinson: G4QZ465V, heard in July 2020 and leave to appeal was refused and that route was not pursued.  The Judge concluded that such claims are proceedings with 'an improper collateral purpose'.   This Judge - and others who have since copied her words and struck dozens of cases out in late 2020 and into 2021 - went into significant detail and concluded that parking operators (such as this Claimant) are seeking to circumvent CPR 27.14 as well as breaching the Consumer Rights Act 2015.   DJ Hickinbottom has recently struck more cases out in that court area, stating: ''I find that striking out this claim is the only appropriate manner in which the disapproval of the court can be shown''.w
    You never know how far you can go until you go too far.

    This is the same as all the Excel cases.  Nothing unusual and unfair PCNs are easy to beat in court.  There was no appeal worth trying because the current system is considered by many to be a biased kangaroo court, hence why the Government is stepping in to regulate the industry.

    This is not rare, easy to beat but the love of God stop panicking about a 'solicitor's letter that is in fact a company with connections to Excel.

    What to do? 

    Read the NEWBEIS thread, top of the forum, and any Excel threads and stop thinking this is unusual. This is why the Govt has stepped in.  What your OH needs to do and how to win in court is shown in the NEWBIES thread 2nd post.
