Email the CCBC in your wife's name , attaching a copy of the claim form as proof of I D and state that the AOS was filed incorrectly and attach a copy of the filled in aos paper form too , filled in and signed by her and ask them to amend the AOS to reflect it came from her by email
Better to get in front of it asap , than explain later , so cover yourselves , and no more Identity mistakes going forward

drivingmecrayzy said:I completed the AOS online on 1st April.
I created a gateway I put my details as the contact correspondence but my wife is the named defendent.
However I signed the AOS in my name as it said underneath the signature section (defendent)(Defendents Legal Representitive)(Litigation Friend). So I assumed this was OK as I was helping her to complete the online paperwork. Is this not the case I am now worried I have done something wrong up to this point.
Paragraph 2.3 of Part 2 of the CPR defines a “legal representative” as a- Barrister;
- Solicitor;
- Solicitor’s employee;
- Manager of a body recognised by the SRA; or
- A litigator authorised under the Legal Services Act 2007.
A 'Litigation Friend':
From Gov.UKYou can be appointed as litigation friend to make decisions about a court case for either:
- an adult who lacks the mental capacity to manage their own court case either with or without a solicitor
- a child
The court case can be any of the following:
- a civil case, except a tribunal
- a family case
- a Court of Protection case
You’ll have to go to court if there’s a hearing, but you cannot act as the other person’s lawyer.
An adult with a litigation friend is called the ‘protected party’ in court.
Always check. Google is just 6 letters away.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

No , but keep checking MCOL claim history in case they update it
No more paperwork will be returned , only emails to the ccbcaq email address
So no more posting of any paperwork , plus nothing else on MCOL , except checking it , read only mode from now on
The actual Defence will be signed by your wife and emailed by her too , like the defence template thread tells you , so read it carefully2 -
She signs a white piece of paper and takes a photo. This cropped appropriately photo is pasted into the defence document, and then you output to word
NEVER needs a printer!3 -
Thank you so much for all of your prompt replies. Your help is very much appreciated.1
