Brand new tap leaking - Can I claim for cost of plumber refitting

    you by a plant from a garden centre it dies - the garden the centre says they will replace it can you claim for the mulch and fertiliser used in planting the first plant

    i have replaced several taps over the years and i always check they work first.
    How do you  check the tap without fitting?, and did the op do the old trick of running both taps on full for a few mins ( turn the boiler off if poss) to remove dust/ swarf?

    Do you mean it drips through the outlet when you turn it off or does it leak from somewhere else?

    I connect the new tape to the mains and see if it drips etc before installing it - I have a 1 metre long flexible hose that goes between the tape and the copper pipe where the tap connects. Particularly so if the installation is fiddly etc. But looks like even that would not have detected this slow-leak fault (I assume the OP means the tap drips)

    Section 23 of the Consumer Rights Act 2015 answers your question...
    23 Right to repair or replacement
    (1) This section applies if the consumer has the right to repair or replacement (see section 19(3) and (4)).
    (2) If the consumer requires the trader to repair or replace the goods, the trader must—
    (a) do so within a reasonable time and without significant inconvenience to the consumer, and
    (b) bear any necessary costs incurred in doing so (including in particular the cost of any labour, materials or postage).


    From that it is clear that once it is decided that the seller needs to replace the product, then the seller must cover the cost of actually removing the faulty part and the installation of the replacement.

    It's dripping from the mixer lever.. very slowly. Probably that much every hour.. 

    The latest is that they have agreed to to send out a replacement, and have arranged for a a pick up service to collect the faulty tap in a week or so.

    They have repeatedly insisted that it is not their policy to reimburse additional costs, but have offered a credit voucher, but will not confirm the value.

    While I appreciate the 'gesture' I think the passage posted by wealdroam is quite clear. I shall respond to their last message with this.

    Section 23: Right to repair or replacement
    132. This section details a consumer’s right to insist on repair or replacement of faulty goods, the cost of which must be borne by the trader. This includes the trader bearing any costs involved in the removal of an installed item and reinstallation of a replacement. A replacement would usually need to be identical, that is of the same make and model and if the goods were bought new then the replacement would need to be new.
