    Is there no alternative as I don’t feel why they are doing is fair.
    What's unfair about it? They're offering to rent it to you for £60 a year. No, I doubt it's worth their while evicting you, but what's fair about you occupying somebody else's property without permission?

    In reference to my other question, if I have built an extension on my leasehold land can they make me pay a variation fee for building the extension even if my lease doesn’t mention it.
    If there's nothing in the lease requiring you to get consent or prohibiting what you've done, you've nothing to worry about.

    When I bought my house there was a garden which was available to rent at 20 pounds a year.  It cost me over 700 pounds in legal fees to transfer over to my name.  Two months later I was sent an email to say  land was being sold and would I be interested in purchasing.  I had 3 days to inform them as they had a buyer.  Unfortunately, I was on holiday and didn't read the email in time.  Later I found my neighbour had purchased the land.  Not too bothered as I am renting it out.

    You are occupying their land, without permission.

    You are almost certainly in breach of the conditions of your lease. So, yes, it is possible. This isn't a simple financial debt which is not enforceable once six years have passed.

    But remember that you're talking about two different titles here.
    You are in breach of your leasehold title.
    You are occupying land which is part of their freehold title, and which is not leased to you.
  • I would ask them for a price for the freehold of the house and portion of garden.

    Thanks for all your comments, some of my neighbours have given in and agreed to rent the gardens from the company for £5 per month. They are asking for a one of fee of £110 to create a license thought and I think this is a little steep. What could they reasonably do if I refuse to rent it and carry on using the land?
  • I’ve also had a run in with this firm, I’ve posted about it in the consumer rights forum. I can’t post a link as I haven’t been a member long enough. Does this post relate to land or property in Walsall as that’s where I’m based and where I’ve come across them.
