    In the first instance give the CCBC a ring and ask them innocently why they have not yet sent you a DQ.

    That might prompt them to do the right thing and at least wonder why the Claimant hasn't indicated their intention to continue.

    Yep, or download one and email it anyway to the CCBC and say, if the claimant has left the claim dormant and not indicated they will proceed, you object this claim being 'warehoused' like this and ask that it be struck out.

    AND WE NEED PEOPLE LIKE YOU SOON - THIS IS REALLY IMPORTANT PLEASE:

    The new (final) Government Consultation this Summer is something you must make sure you get your say in, given what you've been through.

    Please, please come back every week to check and make sure your voice - AND YOUR FRIENDS’ AND RELATIVES’ VOICES TOO -  is/are not missed from this final opportunity to take part in the Government Consultation, coming very soon!

    @Troubled42

    Has the Excel case been heard yet? I wondered if they had discontinued.

    As per advice, we reached out to CCBC in relation to the claims. as a courtesy we also sent the DQ's for both claims. We also put a line in there about objecting to the warehousing of the claims in the current circumstances.

    The following response was received (after 2 weeks);
    Good afternoon,

    Please find attached your Directions Questionnaire which is returned to you as the claimant has not informed us whether they wish to proceed with this claim.

    The Court will notify you if a Directions Questionnaire should be filed.

    If you require any further information please contact our helpdesk on the number above. Alternatively you can email us at ccbc@hmcts.gsi.gov.uk; Please ensure that you state the above case number in the subject heading of your email. You may also find it useful to visit the frequently asked questions (FAQ’s) section of our website. To locate this page you should go to www.justice.gov.uk and search for ‘CCBC’.

    Kind regards

    Reply and say you object to the claim being warehoused this long and the fact that a false ‘debt recovery’ sum was added, so you ask that the dormant claim be struck out, with CPR1 in mind.

    No problem, we will compose something a little later on.

    FYI this was what we originally sent;

    Hi there,

    On 6th April you wrote to me that my defence was served on the Claimant in relation to Claims against me, references ClaimNumber1 and ClaimNumber2.

    I acknowledge that this is now over the 28 days in your letter that the Claimant had to respond.

    I have since had no response in regards to ClaimNumber1 and ClaimNumber2.

    If the Claimant has left these dormant and hasn't given any indication on proceeding,

    I do object to this claim being 'warehoused' like this and politely request that it is struck out.

    I have attached my DQ for both Claims in this email for your convenience also.

    Kind regards,

    Well - another two bite the dust :)

    We haven't heard anything for over a year now. I have checked MCOL now and then.
    After checking tonight, the latest entry is;
    "Notification that the claim against you was discontinued was received on 25/05/2022"

    Don't forget the claim & AoS were back in March 2021. The defence followed a few weeks after and they ran away. Bye bye Not So Smart Parking and CST Law!

    As always, thanks for all the helpful advice in this thread and I hope the research / reference images in this thread can help someone else in the future :)

    Let me know if you need anything further.

    Congrats!  A discontinuance is a win.

    ANOTHER ONE BITES THE DUST!

    CST Law don't seem to be bringing claims now (or very few, because we don't hear about claims from them at all on here now).  Maybe they are no good at it!

    We need one more thing, please.

    And we sincerely hope that you are au fait with the need to respond to the final Government Public Consultation?

    We all need to ram the nail in the coffin of the false £70 'DRA fee' add-on, that actually funds the court claim and toxic CCJ culture, as well as the DRA and roboclaim 'legals' gaslighting of people.

    Please come back here when it opens, and you can make sure you don't miss the Public Consultation:

    If you are not a regular reader, to be alerted you'll need to bookmark the thread by MSE_JC at the top of the forum and enable (on your profile) email alerts for bookmarked threads.

    Then join us when the Consultation opens in a few weeks.
