did my car dealer sell me a car without telling me it had been in a accident

    the  bonnet damage was 99.9% the garage as i had just had it mot'd and had driven a minute away when it flew open, sticky catch should have been picked up on mot? 
    The primary catch - the one released from inside the car, yes.
    The secondary catch - the one you release from the front edge of the bonnet, no.

    3.1 - Field of Vision
    You must inspect bonnet catches on vehicles with a bonnet, which would obscure the driver’s view of the road if opened. The inspection is only for primary catches - those that hold the bonnet fully closed. Secondary safety catches are not part of the inspection.
    (b) A bonnet:
    (i) which cannot be safely secured in the closed position
    (ii) seriously at risk of opening inadvertently


    Major
    Dangerous
    (c) A bonnet primary retaining device excessively deteriorated, ineffective or insecureMajor

    And, of course, if the primary wasn't latched properly, you'd have noticed before getting in, right?
  • thanks guys for your help ill let you know how i get on, as i always say  lesson learnt lol at a cost as usual just told my son to get his new used car checked independantly for any issues before his 14 days up

    Of course, your big issue is going to be getting them to accept the damage was there when you bought the car - a year and a half ago, six months before the MOT flagged it...

    Just out of interest OP if you were backing down your drive and hit you garage door, causing no visable damage but an internal plastic catch had broke behind the rear light (which you knew) would you tell the person buying your car when you came to sell it years later?
    ( We all know the true answer by the way ) ;)
