TERMS AND CONDITIONS for “WIN UP TO £10,000 ON THE DAVE BERRY BREAKFAST SHOW THANKS TO SKY MOBILE” (the “Competition”).

 

These terms and conditions (the “Specific Terms”) for the Competition should be read alongside  our general competition terms and conditions at: http://www.bauerlegal.co.uk/radio-competition-terms.html (the “General Terms”) which will also apply to this Competition. Where there is any conflict between these Specific Terms and the General Terms, the Specific Terms shall prevail. 

 

1.ENTRY ROUTES AND COSTS	Entries are restricted to one [1] entry/ per person.  Pre-registration to play the on-air competition is available via the following route:  (A)     Online at https://planetradio.co.uk/absolute-radio/competitions/      Online entry is free of charge.
2.COMPETITION MECHANIC AND HOW TO WIN	2.1 ONLINE PRE-REGISTRATION  Anyone interested in playing the on-air game must pre-register their interest on the online competition page which includes agreeing to these terms and conditions. Refer to Section 1 for Entry Routes. Pre-registering your interest to play the on-air game does not provide any guarantee that you will play the on-air game or win a prize.   2.2 SHORT-LISTING  The Absolute Radio Breakfast production team will draw a shortlist of potential contestants at random from the pre-registered entries submitted, at various points throughout the pre-registration period (Refer to 3. Entry Period). The Absolute Radio Breakfast production team will contact potential contestants to check their suitability, eligibility and availability to play the on-air game. Being contacted does not guarantee you will play the on-air game. Being invited to play the on-air game does not guarantee you will win the prize. If you have been selected to play the on-air game, you must follow all technical instructions given to you by the Absolute Radio Breakfast production team. You must also be contactable on the phone number you provided and, on the time and date agreed with the Absolute Radio Breakfast production team.  The Absolute Radio Breakfast production team reserve the right to choose another contestant from the shortlist if they are unable to contact you or if you do not fulfil these terms and conditions.   2.3 PLAYING THE ON-AIR GAME  The competition round will be broadcast on-air during the Absolute Radio Breakfast Show between 06:00 and 10:00, Monday to Friday between 29 March and 02 April 2021. The competition round may be pre-recorded at a different time to the ‘as live’ broadcast and the contestant must be available at the time communicated to them by the Absolute Radio Breakfast production team. The on-air game involves answering a set number of general knowledge questions within a time limit set by the Absolute Radio Breakfast production team and presenters to win a cash prize. If the contestant answers the set number of questions correctly within the time allowed, they will ‘bank’ that day’s £2,000 cash prize and progress (or ‘roll over’) to the next competition round to play for an additional £2,000. If the contestant fails to answer the required set number of questions correctly within the time allowed, they will win the cash amount they have ‘banked’ up until that point and leave the game. If any contestant hasn’t banked any money, then they will leave the game without a prize and the £2,000 that was not won during that competition round will be rolled over to the next competition round, increasing the next contestant’s first competition round cash prize to £4,000. The most a contestant can win during the competition week is £10,000. All final decisions will rest with the Absolute Radio Breakfast production team.   2.4 HOW TO WIN To win the cash in any competition round, the contestant must answer the set number of general knowledge questions correctly and within the time allowed. For each successful competition round, the contestant will bank the cash prize from that competition round and automatically progress (‘roll over’) to the next day’s competition round to play for an additional £2,000. The game is over for any contestant when they fail to answer the required number of questions within the time limit or at the end of the week – whichever comes first. Whenever a contestant exits the game, they will win the cash they have banked up until that point.  In the spirit of the on-air game, whenever a contestant leaves the on-air competition with a cash prize, the presenter will ask the contestant to choose what to do with their prize: keep it all for themselves, share it with someone else or reward the whole lot to someone who deserves it. The contestant’s answer will not affect how the cash is awarded. i.e. it will be the contestant’s responsibility to share or reward any cash to anyone they mention in the on-air segment. If the contestant wins a prize and it is subsequently discovered that they do not fulfil these specific terms and conditions, nor the general competitions terms and condition, they will be disqualified. General terms and conditions can be found here: http://www.bauerlegal.co.uk/radio-competition-terms.html   2.5 EXAMPLE OF HOW TO WIN  MONDAY / DAY 1 -          Contestant 1 answers the questions correctly and within the time allowed, and wins £2,000.  -          We ‘bank’ this £2,000 and roll it over to Day 2, when the contestant will return to play for another £2,000.   TUESDAY / DAY 2 -          Contestant 1 returns to play, with £2,000 cash guaranteed in their ‘bank’ and another £2,000 to play for in today’s competition round.  -          Contestant 1 does not answer the questions correctly and/or exceeds the time allowed. -          Contestant 1 leaves the game with the £2,000 they banked from Day 1.  -          In the spirit of the game, the presenters will ask if they’re going to keep the £2,000 for themselves, share it or reward the whole lot to someone else. -          The Breakfast show rolls over the £2,000 Contestant 1 didn’t win to Day 3 for Contestant 2, who will be playing for £4,000 in the Day 3 competition round.   WEDNESDAY / DAY 3 -          Contestant 2 comes on and does not answer the questions correctly and/or exceeds the time allowed.  -          The £4,000 Contestant 2 failed to win is rolled over to Day 4, where Contestant 3 will play for a total of £6,000 (£4,000 from Day 3 plus an additional £2,000).   THURSDAY / DAY 4 -          Contestant 3 comes on, answers the questions correctly and banks the £6,000.  -          Contestant 3 will return to play on Day 5 for an additional £2,000, knowing they have secured £6,000 in the ‘bank’.   FRIDAY / DAY 5 -          Contestant 3 returns for the FINAL day of the on-air competition.  -          Contestant 3 answers the questions correctly and secures the additional £2,000 on top of the £6,000 they ‘banked’ on Day 4. Contestant 3’s total winnings is now valued at £8,000 cash. -          As it is the end of the week, the on-air competition ends, and Contestant 3 is awarded their cash prize. -          In the spirit of the game, the presenters will ask if they’re going to keep the £8,000 for themselves, share it or reward the whole lot to someone else.
3. ENTRY PERIOD	Online pre-registration must be submitted during the following pre-registration period:  From 24 March 2021 at 00:01 (the “Pre-Registration Start Time”) to 01 April 2021 at 09:00 (“Pre-Registration End Time”). Shortlisting will take place throughout this period.  Entries received before the Pre-Registration Start Time or after the Pre-Registration End Time will be invalid.  The on-air competition rounds may be recorded at any time during the following recording period:  From 26 March 2021 (“Record Start Time”) to 02 April 2021 (“Record End Time”). Contestants must be available to record at the time and date given by the Absolute Radio Breakfast production team. The on-air competition rounds will broadcast during the following broadcasting period:  During the Absolute Radio Breakfast show, between 06:00 and 10:00 Monday to Friday, from 29 March 2021 (“Broadcast Start Time”) to 02 April 2021 (“Broadcast End Time”).  Winner Announcement. The name and the hometown of the winner(s) will be announced during the broadcasting period.  If any winner cannot be contacted or does not provided the required details to fulfil the prize within [21] calendar days from the date of winning a prize as part of the on-air competition, the prize will be forfeited.
4. ENTRY RESTRICTIONS	Open to UK residents aged [18] years or over on date of entry.  Our employees (and their family members) or employees of any company involved in the Competition, including any Prize Provider, are not permitted to enter. We reserve the right to disqualify any entrant or winner who does not comply with any of the eligibility criteria and/or is in breach of these Terms. We reserve the right to repeat the competition mechanic or any stage of it in order to draw a winner that fulfils all of the eligibility criteria and is in compliance with these Terms. If anyone has won a competition on any Bauer Media brand to the value of £500 or more in the past 6 months, they or any person at the winning address will not be eligible to win the competition. 5. THE PRIZE	These are the prize conditions for the on-air competition: There will be a maximum of £10,000 cash available to win during the on-air competition week. This represents 5 days of £2,000 being added each day. As described in 2.COMPETITION MECHANIC AND HOW TO WIN, if the contestant fails to ‘bank’ a particular day’s £2,000 cash prize, that £2,000 will be rolled over and added to the next day. This means the next contestant will be playing for £4,000 in their first round. This roll over method will continue as the week goes on if contestants continue to answer the questions incorrectly and in the time allowed.  Prizes are non-transferable, non-refundable and no alternative will be offered.

 

OTHER CONDITIONS

 1.       DATA PROTECTION. Names, email addresses, and /or telephone numbers (which, for all SMS competitions, will be shared with our SMS provider) will be collected and used to process entries. Winner’s details may be given to a Prize Provider to arrange delivery of the prize.  Your details may remain stored after the End Date but will not be used for marketing unless you have ticked an opt-in box on entry. For SMS entries you automatically consent to receive marketing. You may opt out at any time by texting the word STOP to the relevant text shortcode number. If you have opted in to receive marketing communications, then your details will be used in accordance with the information given when you ticked the opt-in box and gave your consent.  2.      INTELLECTUAL PROPERTY AND CONSENTS. By entering this Competition, you are consenting to our use of your entry both to publicise this Competition, our radio station or any other radio station which we own or control. This means that we may use all names, images, descriptions, photographs video footage, and other information, which you have submitted on entry, in any media, without paying you any remuneration therefore and without any time restriction. You also agree that we may film, record or photograph you in connection with the competition and /or the Prize if applicable. We will own these films, recordings or photographs and we may use them publicly, including on the internet, for our radio broadcasts and/or for any promotional purposes. You will also have waived any moral rights or right to payment that you may have had. 

3.         MISCELLANEOUS. 

• Entries which do not comply with these Terms or the General Competition Terms and Conditions will not be accepted and any entries may be disqualified if we have any reason to suspect that there is a breach of, or non-compliance with, these Terms.
• Where a competition mechanic involves the answering of questions, the correct answers to questions must match our answers to win (or be sufficiently close in our sole reasonable opinion) to be acceptable. In the event of any dispute about any answers given and whether they are correct, we reserve the right to amend what we deem a correct answer, however we are not obliged to, and our decision in either case is final and no correspondence will be entered into. 
• We are not responsible if you fail to get through when you call / text to enter, or if you lose signal during a call. 
• You are responsible for all costs of entry and where necessary, obtaining the bill payer’s permission. Please refer to your tariff with your network provider for information about charges you may incur for entry into our competitions via any SMS or phone call entry route. 
• We accept no liability for network, technical or signal errors, issues or failures experienced by entrants when entering the competition or at any stage during the mechanic of the competition. 
• Whilst on-air, you must not make any inappropriate, profane, indecent, harmful or offensive statements. If you do so we reserve the right to take you off-air immediately and disqualify you from the competition. You may be also disqualified from the competition at any time if you are incomprehensible, inaudible or if you appear to be driving, intoxicated or likely to offend listeners. Any prize already won may be withdrawn and re-awarded to another entrant.
• As far as it is lawful to do so we exclude our liability for any losses suffered in connection with the Competition or any element of the Prize. 

We may cancel, end or suspend the Competition where we are required to do so in circumstances outside our control. We reserve the right to amend these Terms at any stage during the Competition if such amendment is necessary to facilitate the administration of the Competition.
