    The 'normal' procedure would be

    a. obtain death certificate (several copies)

    b. agree someone will obtain Letters of Administration (i.e. Probate) (usually the next of kin or relative... its simple but a little time consuming)

    c. write to creditors (i.e. the loan company) with a copy of Death Certificate and explain there is no money in the estate... lived in a council house on benefits etc and say the payments will cease.

    They can only pursue the estate and not your MIL for the debt.

    From what you say your MIL can't cope with this situation and needs some help... could someone go to the CAB with her?

    She can`t cope, as i say i`m miles away and only contact is postal letters.
    I`m hoping to get down there before christmas too help, i thought other family members were going to help, but have just found out this is not the case.

    I`m going to go down to see her next weekend, can any one give me a list of exactly what i should be getting, doing for her, i will only have 48 hours to get this sorted, so a much help as possible would be really appreciated.

    Is she old? Can you try to get Age Concern to pop round and help her sort it out?

    What about Social Services as she's vulnerable?

    I think you needs to contact the loan company,

  • Clapton - in most cases where the estate is £5k or less there is no need to obtain Probate (if there is a will) or Letters of Administration (if there is no will).

    It looks on the face of it that there are no assets in the estate here so I would just write to the bank enclosing death certificate and asking bank to stop payments to the loan if they are coming from a joint account.(Presuming the loan was in a sole name)
    They would be automatically stopped (with all other payments) if it was a sole account.
