Hello Community,
I need your honest advice, please.
I am currently working in the health care sector, HCA with minimum wage, I not so long ago sent a friend of mine a photo in confidence and trust, we had known each other for 2-3 months, recently she had fallen out with me over an argument and I apologized to her my blind spot but she would not accept. Rather, she used a third party person a male to deliver the photo that I sent to her to my Home manager. 2 days ago, without notice my employment terminated called "Gross Misconduct", during the meeting I asked for information on how the photo come about in there possession, I was told through a third party male, no information of that person was shared, correctly so.
I ask my manager to give me a chance with a final written warning because this a case of Gross Negligence and not Gross Misconduct. Now it is damaging my livelihood, and I have a child to look after too. I had been there 2 years almost, never had any trouble, and well like an employee with a good reputation.
But my manager said that he can not show any favour, as they dismiss another employee, took a photo and put it on Instagram!, but I argued, it is not the same as impact on the business in my case is less damaging than the one on the Instagram.
The manager, decline to consider my request, so respectfully shook my hand and left the place.
Since then I have not heard back from them,
How shall I proceed community, please guide me as I want to be a good father and do the honourable things for my daughter, she is in tears for a couple of days, it breaks my heart?
Thank you in advance
Nathan

Surely there is no real difference between Gross Negligence and Gross Misconduct. In fact negligence at any level is misconduct. If the photograph you send showed you doing something you shouldn't have done, your former friend was absolutely correct to pass it on to management, irrespective of their motive for doing so. I don't think you have any chance of getting the decision reversed. The best you can hope for is that they agree to give you a neutral reference simply stating the role you were employed in along with start and finish dates.

What did the photo show? Personal or work-related?If you’d been there more than 2 years you’d have had more of a chance but there’s little employment protection before that for this sort of issue.
Were to able to discuss the possibility of a reference that just gives dates and nothing else?
Lesson for the future - don’t ever send photos which can compromise you in any way to anyone, let alone to someone you’ve only known a couple of months. You should also take your name off your first post. Best not to put any identifying details out on a forum in these circumstances. All shall be well, and all shall be well, and all manner of things shall be well.
Pedant alert - it's could have, not could of.1 -
You need to 'proceed' by trying to get yourself another job, although if the photograph was of a patient, you will probably have to look for something other than a Health Care Assistant.2
-
The issue is the fact that you took this photo which I'm guessing you were not meant to. Possibly doing something that you should not be doing. Regardless whether you put it on Instagram, Facebook, shared it with close friends or had it printed on a t-shirt, you still took the photo which you obviously know was wring/inappropriate/illegal* delete as appropriate and the management has acted appropriately.
It is only your actions that has damaged your livelihood and hurt your daughter. All you can do is try to find another job, but remember your reference is likely to say dismissed for gross misconduct on it.5 -
Is there any point on asking about the nature of the photo (without specifics?)
Obviously we don't know what it was of but if it contained anything to do with a patient, personal information or anything that could put the company into disrepute I'd personally say chances of getting anywhere are nill.2 -
Why, when you'd only known her a couple of months and could not have any idea if she was trustworthy? What was the photo of?Nathan176 said:

I hope it wasn't the health care equivalent of being photographed sitting on a horse!!!
But it must be pretty bad to be sacked over. I'm guessing it's not just of you enjoying a tea break in the staffroom! How's it going, AKA, Nutwatch? - 12 month spends to date = 3.24% of current retirement "pot" (as at end December 2025)1 -
What you're not recognising is that your actions are every bit as egregious as your colleague who posted on Instagram. You sent the picture to one person who has, at least, forwarded it to one other - and at any time that picture could be plastered all over the internet and you won't be able to stop it. You, and only you, created this situation.Nathan176 said:But my manager said that he can not show any favour, as they dismiss another employee, took a photo and put it on Instagram!, but I argued, it is not the same as impact on the business in my case is less damaging than the one on the Instagram.6 -

What about basic reference, would this be possible, as I have a job offer pendingHello Community,
