Text to Win Terms and Conditions

1. The prize draw will be open on 19 March 2021 at 10:00 GMT and close on 20 March 2021 at 00:00 GMT.

2. Entry to the prize draw is only by texting the keyword SUN to short code 81155. Text messages will cost your standard network message charge (based on your service provider rates – please check with your provider). You will then receive a free bounce-back message from 62345 informing you that a voluntary donation of £10 to Comic Relief will be taken 60 minutes after the entry text was received, unless you reply to 62345 with the word CANCEL before 60 minutes has passed. If you don’t respond CANCEL to 62345 within those 60 minutes, you will then receive a text from 70210 confirming your donation and asking you if you’d like to make a Gift Aid declaration. By taking part in this prize draw, you agree to be bound by these terms and conditions.

3. For the avoidance of doubt, opting out of the voluntary donation will not affect your entry into the prize draw.

4. The prize draw is open to all residents of the UK, aged 18 or over, except staff members of Comic Relief (the organisation behind Red Nose Day), of BBC Group, of any of the prize providers, and their close relatives, or anyone connected with the prize draw. Proof of age, identity and eligibility may be requested. For the avoidance of doubt, none of these individuals may partake in the prize as a guest of the winner (where applicable).

5. Please ensure you spell the keyword correctly and send your text message to the correct short code, however, if we, acting reasonably believe you are trying to enter, we will still accept the entry even if you entered the keyword incorrectly. Alternatively, we may instead send you a message to let you know that your entry has failed. The message we send to you in this instance is not a confirmation message so, whilst you will be charged your standard network message charge, you will not be entered into the competition and will not be donating to Comic Relief. If your text message is received outside the times and dates specified for the prize draw, you will not receive a bounce-back message but may still be charged your standard network message charge. You will not be donating to Comic Relief nor will you have entered the prize draw. You will not have been added to any marketing databases if we send you a follow up text unless you have expressly requested to be.

6. You may enter the prize draw a maximum of four times a day (midnight to midnight UK time). You will receive a free bounce-back message to confirm your donation each time you enter, and if you wish to opt out of the donation you need to respond to each such message received from 62345 by texting the word CANCEL to 62345. If you try to enter into the prize draw more than four times a day, you will still be charged your standard network rate but will not be charged any donation to Comic Relief. Also note that pre-paid customers who are trying to donate £20 or £30 but have insufficient credit, may only be charged £10 or £20 (as applicable).

7. There is only ONE prize available to be won. The prize consists of:
a. 7 nights all-inclusive stay for 2 adults at BodyHoliday, a 5* wellness resort in St Lucia. For the avoidance of doubt both the winner and the winner’s guest must be aged 18 or over. These terms and conditions apply to both the winner and the winner’s guest;
b. One free spa treatment per day, per adult for the duration of the stay at BodyHoliday, exclusive of the day of arrival and the day of departure. The free spa treatments only include treatments contained within BodyHoliday’s inclusive treatment list (All Inclusive Spa Resorts | Therapy | The Body Holiday). Any other spa treatments are not included.
c. Two British Airways World Traveller Plus return flights from London Gatwick Airport (LGW) to Hewanorra International Airport (UVF) in St Lucia. This is inclusive of 23kg piece of luggage per person and all reasonable transportation taxes, fees and charges relating to those flights; and
d. Comic Relief will cover your reasonable travel costs to and from London Gatwick Airport (up to the value of £200 and to be agreed in advance with Comic Relief). Other transfers, travel visas, travel insurance, personal expenditure, Covid-19 tests, vaccinations & supplementary meal/drinks choices and tax are not included. The prize winner and winner’s guest are responsible for supplying valid passports, visas and obtaining inoculations and/or medical tests that may be required to visit St Lucia. Any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the prize are the responsibility of the prize winner.

8. The prize is valid for travel between 01 July 2021 and 21 December 2021 inclusive or between 01 May 2022 and 31 October 2022 inclusive, subject to travel restrictions. Rooms are subject to availability at the time of booking. This prize consists of accommodation on an all-inclusive basis. The prize is valid for 2 adults sharing a run of house category room. The entirety of the prize (i.e. flights, resort stay and spa treatments) must be used at the same time. Both tickets (i.e. for the winner and the winner’s guest)_must be redeemed at the same time and cannot be split. . Travel restrictions may apply, please check FCDO advice before travelling.

9. The flight tickets are for British Airways operated flights only. Travel on British Airways Franchise, code share or alliance partner airlines is not included. Flights will be inventory controlled and are subject to availability and capacity control. Therefore, it may be difficult to obtain your first-choice flights during peak travel periods including but not limited to: school holidays, mid-term breaks or sporting events. British Airways reserves the right to limit the number of prize travel seats made available on any flight. It is possible that there will be no prize travel seats allocated on a particular service or the flight may be fully booked for prize travel seats, even though other seats are still available in the same cabin. British Airways does not accept any responsibility in the event that the winner is unable to book their preferred flight(s).
10. All travel on British Airways flights is subject to British Airways’ General Conditions of Carriage for Passengers and Baggage (https://www.britishairways.com/en-gb/information/legal/conditions-of-carriage) and the notice and conditions of contract contained on each ticket or itinerary

11. Reservation changes are not permitted after tickets have been confirmed and issued.

12. The winner will be selected using an independent randomised draw system on 20 March 2021 and Comic Relief will attempt to contact them that day by phone. If the winner does not answer within 48 hours after Comic Relief’s reasonable attempts to contact them (meaning 4 calls per day at various times of the day) Comic Relief will move on to contact the next randomly selected winner.

13. For the avoidance of doubt, unless specified elsewhere in these terms or otherwise agreed in writing, the winner is responsible for all arrangements and costs required to access the prize including but not limited to, travel and accommodation costs, and no other costs or expenses will be covered by Comic Relief, the BBC, or any of the prize providers.

14. Any accessibility or dietary requirements for the winner or their guests need to be disclosed to Comic Relief within two weeks from notification of the win. The winner and their guest may need to adhere to Health & Safety requirements imposed by Comic Relief or any venue associated with the prize.

15. Comic Relief and the BBC’s announcements as to who the winner is, are final. No correspondence relating to the prize draw will be entered into. The prizes are as stated. There is no cash alternative and the prizes cannot be sold or transferred in any circumstances.

16. The winner and their guests agree to take part in any reasonable post-prize draw publicity with Comic Relief if required.

17. Comic Relief must publish that a valid award took place. To comply with this requirement, Comic Relief will publish the surname and county of the winner and, if applicable, their winning entry on comicrelief.com on 26 March 2021. The BBC will also publish information on the winner on its website in order to comply with its legal and regulatory obligations.

18. If you object to any or all of your surname, county and winning entry being published or made available, please contact Comic Relief by emailing us. For the avoidance of doubt, Comic Relief must still provide the information and winning entry to the Advertising Standards Authority on their request.

19. The prize is subject to change. Descriptions of the prize are provided without a warranty of any kind. In no event shall Comic Relief, the BBC or British Airways be liable for any claim demand or damages caused to an entrant by reason of a description of the prize being inaccurate, incomplete, or for the prize being otherwise in any way different to the entrant’s expectations, or for any failure to perform, or delay in performance of, any of their respective obligations that are caused by events outside of their reasonable control. Comic Relief reserves the right to disqualify any entries that breach these rules or are in any way fraudulent. Comic Relief reserves the right to cancel the prize draw at any stage, if deemed necessary in its opinion, or if circumstances arise outside its control. In no event shall Comic Relief, the BBC or British Airways be liable under or in connection with these terms and conditions or otherwise in relation to the prize for any special, indirect or consequential losses incurred by the winner or their guest in any way. Nothing in these terms and conditions will operate to exclude or limit Comic Relief’s, the BBC’s or British Airways’ respective liability for death or personal injury resulting from that party’s negligence, fraud or fraudulent misrepresentation, nor any other liability which cannot be excluded or limited by law.

20. The prize will take place after the UK government issues COVID-19 guidance confirming it is safe to do so, on a date notified to the winner by Comic Relief via email. It is the winner’s responsibility to ensure that they, and (where applicable and permitted) any guests they bring to the event, comply with legal requirements relating to the COVID-19 pandemic.

21. Comic Relief, the BBC and their sub-contractors, subsidiaries and/or agencies (including Fonix) cannot accept any responsibility whatsoever for any technical failure or malfunction or any other problem with any telephone network or line, system, server, provider or otherwise which may result in any text not being properly received.
