Help how do I find my IVA record

Hi!
I am living a nightmare as my IVA ended in 2011. The IVA company was Blair Endersby, then it went to Bains & Ernst but then I found out in 2014 it went to Grant Thornton. The reason I’m asking is my IVA never sent me a completion certificate, I moved and they didn’t inform me of anything more. UNTIL I found out a DECADE later in late 2020 that capital one have a balance that was not cleared so although was listed in the list of payees- it seems the balance was never paid or any sums I paid ( I paid in over £5000) they have no record of receiving the money. ALL the other creditors have and it was all cleared of my file. I don’t know what to do to rectify this I think it’s awful I have to actually now reopen this horrific time of my life I want to forget. Who and how can I get help? I don’t know where to turn and I’ve been advised to seek advice?! Will the insolvency service help as I don’t know what to do? I want this debt off 2006 gone it’s not fair. It makes me think they have mislead me and as my IVA was passed around like a hot potato - it’s inhumane how its being treated. Any help would be greatly appreciated.

Thanks in advance.

Well try and calm down for starters, worse things happen at sea.

The fact you never received a completion certificate is by the by, you don’t really need it.

Its up to the creditor to make a claim on your arrangement, only then can your IP make a disbursement to them.

If they never claimed the money, then that’s there tough luck unfortunately.

No record will exist now, far too much time has passed, and after a decade, the debt will have become statute barred anyway, so what exactly was your question again ?

  • Hi

I’m being demanded to pay the outstanding debt on my account that was not cleared in the IVA over the 5 years. They were listed as a creditor so of course they should of been paid something. I’m told by them ( capital 1) that I have to pay the £620 that wasn’t paid in 2006 even after the IVA ended in 2011. It makes me think they never got a penny? All the other creditors wrote off my debt and I’ve even had PPI back! So I’m in a pickle to resolve it. ???

    What is statute barred?
Limitation act 1980, debts cannot be chased forever, they have 6 years in which to claim the money from you, after that the debt becomes statute barred, which means they can’t take legal action against you to reclaim the money, as I mentioned above, the creditor didn’t claim there money, when they should have done, that is their problem, ignore what else they may tell you.

    Next step?

Write to them, explain to them that under the standard IVA terms and conditions, it is the responsibility of the creditor to put forward a claim for a disbursement on an IVA.

The IP will have given them plenty of opportunity to do so, yet they failed to comply.

Now, due to the passage of time, the debt has become subject to the limitation act, under sec 5 of the act, it will now be statute barred.

You now consider the matter closed.
