Completely wrong, couldn't be more wrong! We win 99% of defended claims here, there are no dead horses being flogged.
Take a break from this tomorrow and have a better read of the forum over the weekend, including other PCM claims where they are always beaten.

In addition to this if case is lost at County Court the cost of fine will increase by £75 (Court and Solicitor's costs) to roughly £325.
It is not a fine and, even if you lose, it is unlikely to be in excess of £200. All the information you need is available in the newbies, have you not read them? Have yo complained to your MP?You never know how far you can go until you go too far.2 -

There is a lot to read. I have read some threads and will read up more at the weekend.0 -
It's either DIY , or employ a lawyer at great expense , the choice is yours , law is never an easy topic , especially civil law and contractual law , so Nobody expects you to be conversant with the law or the procedures. I know 2 solicitors who know very little about this topic who I have assisted in the past (criminal defence law , and wills & probate & conveyancing , being their chosen subjects , not parking )
We can only assist and give facts , links , anecdotes and knowledge , this isn't a legal aid forum , it's a consumer rights forum about parking in the private sector, so ask yourself what would Martin Lewis tell you to do if you asked him on his show ? He would tell you to seek proper legal advice from a qualified solicitor or law centre
We can assist , provide guidance , but you do the heavy lifting , if doing the DIY option2 -
The cost will be £200 or so, made up of
£100 PCN
£25 for them to file the claim
£50 if they paid a solicitort to file the claim
£25 for the hearing cost
Thats it. The added on ruibbish AND the interest should all come off, as they never calc. the interest correctly anyway3 -

Have read many many threads and am struggling to find a generalised defence for points 2 and 3 in the defence template.
I don't want to be cutting and pasting scenarios that are not applicable to my case.
I have gone back to where the incident happened and have taken pictures of the signs and don't believe the sign is forbidding parking without a permit. So can not go down the lines of no contract being formed.
In the the defence template it says to edit points 2 and 3 and say in your own words what happened in your case.
If I do I will just be admitting that I parked in a Visitor's Bay without a valid permit. This is all I can remember of the incident.
Just wondering whether I should be using part of the residential defence by Johnersh. The bit about only admitting to being keeper of the car and denying being the driver for points 2 and 3 as I have never admitted to being the driver at the time of the incident. Unfortunately as mentioned in a previous post I threw all correspondence, I do not know whether proper protocol was followed NTK etc...

I am unable to check my sister's lease for her property to see what it says about parking as we have fallen out.
