Refund via Section 75

Hi all just a quick question I hope someone can help with. We were due to travel with Brittany Ferries but the ferry was cancelled due to COVID. I have tried to claim refund for not supplying service offered as Brittany Ferries have only offered voucher but Tesco bank have informed me that we are outside section 75 regulations as after 120 days but we only knew of this scheme recently otherwise we would have applied earlier.
Looking at thread on this website and comparing chargeback/section 75 it states 120 days for chargeback but for section 75 it’s ticked to say you can claim at any time and not within 120 days.
Which is correct as ideally we want to claim a refund and not a voucher?
Thanks in advance of any help.

The page on this site is correct that chargeback is limited to 120 days but this doesn't apply to section 75.
  • Did you pay direct to Ferry Company and over £100.   Then commence section 75 proceedings. You will need to send all evidence confirming your efforts to obtain a direct refund.

A voucher is considered acceptable as a refund by insurance companies. I suspect Tesco Bank may take the same decision.
Assuming you paid by credit card, not debit card, it is worth asking them for  Section 75 refund.
Section 75 is not available for debit cards.

When were you offered the voucher?
Did you refuse it at the time and state you wanted a refund?
Or did you accept the  voucher but now want a refund instead?

While perhaps advisable, it shouldn't be necessary to send all that evidence to the card company, as s75 acts to hold them directly liable to the customer for breach of contract, so (unlike with chargeback) the customer isn't even obliged to approach the supplier at all before initiating a s75 claim.

Thanks all for your responses much appreciated. Interesting as Tesco told me too late under section 75 although it took them 6 weeks to confirm this.
Yes a voucher is all they offered no refund although we asked them directly at the time which we reluctantly had to accept as no other option.
We wanted a refund at the time but they flatly refused but then found out about section 75.
Thanks all very interesting and useful responses.
