LOWELL / Vodafone

I started to receive letters from Lowell back in August last year. From memory I cannot remember receiving any letters or documents until then. 


It turns out, it is for a Vodaphone account I never had. Ironically, I’ve been with Vodaphone for 13 years and have never changed my account. On top of that, they put a CCJ against my name back in 2018, another thing I found out only when getting my credit reports together for a mortgage. 


I have for the last 6/7 months gone back and forth with Lowell trying to establish what has happened and how the the account was taken out. They cannot and they WILL NOT provide me with a copy of the contract. I have asked them to provide me with the documents they sent to the Court they won’t. I have asked the court to provide me with the documents and they said they don’t have any on file. It is relentless and I’m now at the end of the road with it. 


Vodaphone have nothing on record (presumably because they sold the debt).  


I have gone to the ombudsman who cannot help me as the matter is now a court document and no longer just a resolution between me and Lowell. 


I have made a fraud claim but that seems to give no weight. 


I have also been told by Lowell, the last digits of the bank account the account is set up in and again the bank account is supposedly in my name. When I queried this and asked for more information, (even a bank name) as I know my bank accounts and this matches none of them I was told I would not receive any more information. 


I believe my last and final option is to apply for the CCJ to be set aside, but I understand this doesn’t mean it is over, it simply means if I was successful I would have to argue with Lowell from the beginning. 


Can anyone help or suggest the best route to take? I cannot get a mortgage with the judgement on my record and for something that isn’t mine I find the system makes it impossible to remove something that that seems near on effortless to put against someone!
