No. The 13 months is an absolute time limit. Any appeal attempted after this period will not be accepted by HMCTS, I'm afraid.ohdrar said:The only other tactic I could think of was that she wasn't well enough at the time to file a late appeal itself. Can this ever ben grounds for an appeal beyond 13 months?
Concentrate on the new claim. Particularly if, as you have noted, her conditions / abilities have worsened.
Take poppy's advice and put the failed application in the past. It's out of time.
Be sure to follow through an appeal (if necessary) with the new PIP claim instead.
I'd also be wary of taking guidance from a Facebook group. Help her to get accredited advice.
I would have to completely agree with Alice's previous comment here...

I agree with Alice advice but as said here, seeing as she now wants to appeal and if there is any mechanism by which to appeal then she could. Seeing as I said already she's got time on her hands now and is up to it having already done her new PIP application herself on word document.ohdrar said:
No no I don't think so. Because the illness she applied for PIP with and is on ESA for is all up pretty much the same - maybe slightly worse. But as the appeal is based on how she was at the time of assessment and decision she would be arguing that she is entitled then based on her health at that time.poppy12345 said:That's entirely her decision but as you stated her condition did get worse then this will not be taken into consideration anyway.
But with the new PIP she may be different but I presume that that is fine as well as even if she did win - the award would run up to yesterday only anyway assuming the tribunal were generous.0 -
Repeatedly asking the same question isn’t going to change the answer. After 13 months she is out of time.Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.1

There isn't, as has been advised. With time on her hands she could do some research about PIP and what the descriptors mean. Surely she hasn't filled out the form already?ohdrar said:

It takes me a good few weeks to write all my information when i fill in those forms.

She's already been working on it for a few weeks. Never been building up before applying. Then when I printed of part of the thread and links. She did for each descriptor e.g. budgeting - did a short paragraph on why following with 3 examples and then said where in her records to look. She's treating it different this time around. Its about 6 pages on word she'll just print it off and write on the form boxes - see extra sheet.
Hence why my plea to see if theres anything to be done about the old one, as she now has plenty of time and wants to try anything.0 -
Its a shame really, as if she'd been this on top of it first time around I don't think she'd be in the mess with the old that she is. Then again, few apply for PIP first time without really realising what they're getting in to, I think.0

Hi Alice Holt , there seems to be some sort of problem on my end as I have a notification you added to the thread but I can't see it?

(19th March 6.33pm) You've been given all the advice that's available to give and to repeat that again... 13 months is the absolute deadline, as she has hit that maximum time it's not possible to request the MR or Tribunal.I'm not sure what part of that you're not quite understanding....0
