euro car parks final notification letter

Hi, I need some advice on this. Back in January I was asked to go to the out of hours doctor and wait in the carpark as I had tested positive for covid they were going to examine me there. It was night time, I was short of breath, scared and cold. I went with my husband in the car. A bout a month later we get a letter with a fine for unpaid parking fees. I appealed to them considering the situation and that explaining that the car park was being used as an "examination room", to please reconsider and stop the fine. they wrote back and said i had to pay. I decided to do nothing as I read somewhere that they have no power but now I have received a letter saying if i dont pay they will confiscate the car until the fine is paid for.
The car is a motability car. Can they do this? Can they just appear at my home address and take the car or put something to it so we cannotof the situation use it? PLese advice me on what to do. The fine is only £70 but the amount is not the point but the fact is the situation

    What's the name of the PPC and where did this happen?

    Have you looked at the NEWBIES thread at the top of the board? I recommend getting a cup of tea and reading through it slowly so you can pick up the information.

    Someone else may be dealing with the same PPC and location and you could share notes and information. I think if you've appealed to the PPC, that could rule out the next level appeal - which depends on the PPC: there are 2 trade organisations, BPA and IPC - PPCs can belong to either, and the advice on whether to appeal using the POPLA or IAS systems depends on the case. There is also a evidence, IIRC, that a director of Gladstones solicitors, who are used a number of IPC members to bring court claims, is also a director of the IPC/IAS so there is a conflict of interest.

    I doubt they can take a Motability car unless a judge orders it, but please answer the 2 questions I just asked and wait for someone more familiar with this board to come along, possibly @Coupon-mad as I think this may fall under Equality Act issues, and she's very much clued up on those.

    OK, I have read it again and it says if they don't get the fine paid in full or they have not been made aware of the address for service for the driver they can recover from the keeper of the vehicle ta the time it was parked. This means if the car was still parked there right? 
    The company is Euro Car parks and at the back it says appeal to POPLA? IT happened at the Health centre car park which is no longer free but now it seems to have been taken by Euro Car. Am I am answering to the questions you needed @MothballsWallet

    What happened when you complained to the Health Centre?
    I think you are confusing what you are reading in that letter.  It states that it can recover (or try to) the speculative invoice (not a fine) from the KEEPER of the car if they do not know who the driver was.  It does not say they can recover the CAR.  Read it again!

    No, it means they sue you, of course. 
    They cannot "confiscate the car". They're not the police or anyone of any import.

    Complain to the practice manager of the health centre and get it cancelled , mention the Equality Act 2010 as well , you cannot register the vehicle inside if you were not allowed to , so the practice varied the contract and gave de facto permission to park , so should cancel the PCN

    Nobody can confiscate the vehicle for this , motability are not involved but are the vehicle owner

    I have not contacted the Health Centre. Did not know they can cancel it. I know before it was a free car park  I have never had or was told to register my VRN with the surgery. Apparently now is a private car park run by Euro car. 
    So you think the Helaath Centre could cancel it for me?
