Chargeback time limit

I claimed a chargeback from Santander Mastercard 83 days after service was not provided ,they declined it because it had run over 120
days before they submitted to MasterCard this apparently is my fault.
Do you think I might have a claim with the Ombudsman

Have you tried a section 75 claim?

I was advised by Santander complaints dept to apply for section 75 this was also declined
due to a broken chain (travel agent went bust)

I disagree with the previous poster - if you submitted a claim to Santander (well) within the 120 day chargeback period but they failed to process it within that window and then rejected it on the basis that it was out of time then you have a reasonable case that they're liable for the consequences of their negligence, so if they've refused to see it that way, even after a formal complaint, then yes, escalate to FOS.
