Looks cut and dried to me. It's your word against their paper trail and technical evidence, which shows the money was dispensed and the ATM balanced. You owe them the money and they've taken it. The 243 days is immaterial if they now have the evidence you owe them the money. As far as what rights you have, you need to check what HSBC's complaints process is and decide if you want to take it further. Ultimately, if you still disagree you can take it to the banking ombudsman but in the face of the evidence they have, I can't see you'll get anywhere.hkkosta said:Hi thanks for accepting me on boar so what is my rights in this occasion in July 2020 i was abroad on a little holiday i had a issue with an ATM which didn't dispenser me £102.51 so i called HSBC reporting the problem a refund was provided and no other communication which states on their sitw within 60 days if you don't hear from us thay means your case is resolved so thats how i accepted it until 3rd of March 2021 just less then a week ago i received a letter for this transaction stating i refer to your enquiry regarding your disipute for £102.61 on the 9th Of march we will be debit so make sure you have enough of funds which left me shocked i calculate since my refuns until receiving the letter it has been 243 days passed without a single communication if possible to assist me what i need to do as they already debit my account leaving me overdrawn.... i dont think this is right as they damaged my score already ....thank you in advance.

Bit confused. How on earth do you withdraw £102.51 from an ATM?

Just fill in a complaint on HSBC website and they will soon resolve it. I had to do this0

It’s possible the machine had been interfered with, so it dispensed the money but it was retained within a false dispenser.
It’s worth contacting the local police on the off-chance they had any reports of this around that time. This might help your case or potentially allow you to claim on your travel insurance. Long shot.Raising a complaint with HSBC and escalating to the ombudsman as necessary costs you nothing and might get you a token gesture for the length of time taken to investigate the issue, particularly if the delay was caused by HSBC rather than the foreign bank.0
