    You should tell ESA yourself.

    You should tell ESA yourself.
    I would change 'should' to 'must'.  Never assume that one department will tell another anything.  If they don't it is the claimant who will be held to account for any overpayment.

    As explained in this thread income based benefits are reduced by capital in excess of £6000. However injuries compensation payments, if that is what you have received, are ignored for 52 weeks. If you think that by the end of that time you will still have more than £6000 left then you can put the money into a trust and it will be ignored indefinitely. If you will only have slightly over £6000 then it may not be worth the bother (and I assume there are some costs involved with a trust).
    DLA is not means tested and some of your ESA may be contribution based and that part would not be means tested.

    Yes, it was injury compensation.  My ESA is income related.
    Essentially the insurers paid £13,876 into my bank account three days ago. 
    On top of this amount the insurers had made an additional payment  (last year) of £3000  to the solicitors.  The £3000 was not forwarded to me as the solicitor used it to may for treatment I had already received. 
    So, it other words There had already been £3000 payment made toward the loss and damage amount for (Medication and treatment, traveling expenses, other expenses, care and assistance and future medical treatment) that amounts to, £6,787 which reduces the amount I personally have to pay for the care, future treatments and expenses incurred is £3,787.
    So, I've received £13,876, I've paid off debt of £5,200 and future treatment etc. has been calculated at £3,876 which leaves me with £4,200. Which means I don't have to notify DWP, is that correct?

    Will you be down to that £4200 within 52 weeks? If so it will have no impact on your benefits. If it will taken longer than 52 weeks to get to that level then you might want to consider a trust but that seems unlikely.
    It is probably still sensible to inform DWP about the payments with evidence of what you receive it for. This is just to avoid any future investigation if they see from a data matching exercise that you had them.

    Wonder if I could jump on this Thread with a related question?
    A relative receives Income Related ESA.  He has a small Pension Pot from many years ago when he worked and as he's just turned 55 could now access it by taking either some Tax Free cash or Income Drawdown or a combination of both.  I presume that as long as he takes less than £6k from the Tax Free cash it won't effect his ESA.  But what about Drawdown Income?  I've tried looking for info on this but it all relates to Work & "Earnings" which obviously this isn't.  Can he take a small Drawdown Income each month to supplement his ESA payments without reducing the amount of ESA he gets?
