To clarify , my first post was near post 2 so having carefully read post 1 and not seeing the PPC name VCS , it's no wonder I mentioned it later , because I have only just seen post 2 which is actually where it was mentioned and not post 1 , which doesn't change anything anyway. It is clear that I did not know who the PPC was because I asked who it was in post 3
As mentioned above , letters would definitely have been sent by the CCBC , even to the wrong address , the claim form and the judgment , I do not care why others haven't received them !! As one lawyer above plus one lawyer in my family also said to me recently , both would be issued , or as Nosferatu says , served ( but maybe not to the correct address )
It is complete trash to say no letters were sent , I am positive that the CCBC sent letters to the address that VCS gave them !!
I am also positive that the defendant did not speak to the county court in Northampton !
My advice is consult a lawyer and stop ranting , Martin Lewis would tell you to get proper Legal advice , I agree with him , this is not a legal advice forum , it is not a law centre either.
This is just one example of the legal minefield and obfuscation the OP and partner are getting into
I will recuse myself from this thread with no more input as per the rules here , but I stand by what I said as it is my personal opinion which I am entitled to , even if the OP does not like it !! It explained matters and also highlighted untruths in the original post. The OP asked for further clarifications and then complains when they were given , which beggars belief !
Get legal advice , that is what I said , I won't change that advice , so I will now put the OP on my growing ignore list , because that is what mse admin are telling me to do ! , This is especially true if you wish to raise a dispute with the CCBC in Northampton , to make a case against them , to accuse them of lying , to accuse them of not posting letters ! , you need very , very deep pockets and lawyers to take on the justice system in this country !
The CCBC has staffing issues due to covid19 and working split shifts plus homeworking , so it is not surprising that incorrect information is being relayed over the phone , probably untrained Newbies told to answer the phone ? Who knows ? Nobody said they were perfect and the OP mentioned shocking reviews in Google search !!
My wife received a letter from a very big insurance company today , dated July 2020 !!
I received one recently dated August 2020 from a government department !! Go figure
Mse is not responsible or accountable for what government offices do or do not do , neither are the members here1 -
nosferatu1001 said:No, if the judgement has not been served on parties, there is no judgment. ]
A judgment must be served. If it is not posted to the address on the claim form, it cannot be considered served.
I would suggest those posters are a) mistaken, b ) unsure of exaxtly what to ask for c) have hit a terrible person at the CCBC who is not competent
a= no
b no
c = maybe , but that comment has been repeated at least 5 times by 5 different people on different days1 -
Now its 5 people, up from 3
If they are not serving JUDGMENTS then they have a serious issue. I doubt that is true
