SHOULD I PAY SIP FINE HELP PLEASE

Hi guys
I regularly use a SIP car park and pay on my app, however it wasn’t working one night so I went to get change from literally across the road it was after 10pm so I thought I’d be fine, came back to find a ticket. I have appealed and lost, so currently doing second appeal.

I have evidence that I regularly pay and use the app and a photo which shows how close my bedroom window is from the car park. The defence of SIP is the sign clearly states you can not leave your car unattended, however I never read the sign because I always use the app, I thought you get a ten minute window the sort your ticket etc.
The fine is now £100 should I pay it or will I have any chance of winning if it went to court?
Please help ASAP

Put plenty of evidence into your IAS appeal, bulk it out in the hope that SIP won't have the staff resource (COVID furlough perhaps) to contest your appeal which will mean an automatic win at the IAS. Don't bank on it, very few do win, but there's been a better return in the past few weeks as lockdown bites deeper into PPC income.I have evidence that I regularly pay and use the app and a photo which shows how close my bedroom window is from the car park.Think of it this way, you've been a Man U supporter all your life (other clubs are available!), you've attended every single home match for decades, you've paid thousands of pounds over the years, you use the same turnstile. On Saturday you realise you've come out without cash or cards, you go to your turnstile and explain to the cashier your loyalty, but unfortunately you have no way of paying there and then. Guess the word that comes before 'off'?
Do you have a chance at court? Everyone has a chance, but it depends on how good your defence, Witness Statement and evidence is, and how bad the opposition's submissions are, even then it's down to a Judge. But don't be intimidated by the word 'court', this isn't a criminal matter, it's just arbitration to settle a claim for money. There's no stigma to losing, there'll be no jail van or paparazzi waiting outside for you. Don't overthink this.Should you pay now? I think you're in the wrong place if you're looking for a 'yes' answer.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

What is the exact wording on the sign with respect to not leaving the vehicle unattended?2

The IPC CoP tells you the grace periods allowed , which is not the same as council parking !!

It is not a fine. Only pay it if a judge orders you to. Meanwhile read the newbies and complain to you MP. From what you have told us, if this goes to court they might struggle.

If that is so this is not a car park, surely.?You never know how far you can go until you go too far.1 -
as above you have not been fined, do not attempt to identify the driver, never use terms such as I parked, she parked, friend, uncle, aunt, mother. gather, son daughter, neighbour etc.

thanks guys.I will attach a photo of the sign the parking attendant must have taken. I already ticked the box to say I was the driver when completing the IAS appeal, it wasn’t until afterwards I looked on this forum.My concern is the price has gone from £35 - £100 now because I appealed, and if it was to go court and lose I’m guessing it would be even more, so i was just looking for some advice to see if I had any kind of case. If not I’d just bite the bullet now.1

Admittedly amateur, but to me (without consideration to potential issues with two separate signs and the tiny font used etc), the offer to park is conditional on paying before leaving the car park. To complete the sentence, "you must pay before leaving the car park or you will not be allowed to park". To my mind it falls under the category of forbidding signage. That is to say, no contract was formed and the driver was trespassing. Trespassing sounds worse but a parking company cannot pursue trespass unless they own the land - which is very unlikely.0
