Which means I would NOT risk it, and disagree with C-M. You CAN absolutely apply for a set aside having paid up. There IS a CCJ, even if it is not recorded.
Of course, every CCJ application includes a six point draft order, and of course your draft would include this repayment as a mandatory - not reserved - section.
The obvious reason why you didnt get anything would be the vehicle was not registered at your address. So the obvious step is to ask the DVLA, as they know for sure where that vehicle was registered on that date range4 -
Thank you. And yes the vehicle has moved over with us (and change in V5 done). Both for the same vehicle, reg, and Moto services. So they definitely have done some sort of trace as the 2 letters that arrived on our new address were fairly shortly after we moved over.
I'll complete the 6 point draft and order tonight/tomorrow. I'm a keyworker (public sector) as well (have been working throughout 6 days a week) so not all the time in the world.0 -
Do the complaint to MOTO as your priority and tell them you require their help to ensure that their contractor consents to the CCJ set aside because they used an old address, when in fact they held your new address all along.
A 'CONSENT to set aside a CCJ' application needs no hearing and costs £100 court fee not £255 so you need to spend the weekend getting your head around this, but having done the MOTO complaint first. It is up to you whether you pay the £593 to avoid the risk of temporary credit damage or not.
I can see Nosferatu1001's point but it's a massive sum and we know MOTO are stepping in to cancel these cases and they are pretty quick to respond...so I wonder if this can be dusted off by their CEO talking to CP Plus and making them consent to your set aside, with either MOTO or CP Plus picking up the £100 tab.PRIVATE 'PCN'? GDPR requires that personal data is accurate and up to date.
If you have updated then with your new address then this to me is a clear GDPR breach that has caused you issues. Don't send anything yet but moto may be in a slot of bother hereFrom the Plain Language Commission:

That's the thing I was thinking about as well. The first one was contravention in 2015, the other 2016. Both same car, same reg and same keeper (me). The wrote to the old address about the 2015 ones, the new address for the 2016 ones (so they definitely have traced it, name hasn't changed). But when it came down to county court they stuck it on my old address which they know is wrong (because they already sent 2 letters to the new address, and that contravention is now in the CCJ)Half_way said:GDPR requires that personal data is accurate and up to date.

Yes you have a mandatory set aside there but the question will be who pays you back the £100 court application fee, and whether CP Plus will consent (so that the application cost is £100 and not the higher court fee of £255).
