Get an inspection done as soon as you've collected the vehicle. If there is anything dangerous about the vehicle, it should bring it to your attention to then go back with a breach of contract claim.
And in addition to this, pay for the van with your CREDIT CARD!!!
Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

Either proceed with the purchase, or say goodbye to your deposit. A deposit is not an 'option to purchase'; it is a contract to purchase. Break the contract and you ca expect to lose your deposit.
At the moment I am not breaking the contract. I am chasing them for the 12 month MOT that was advertised and which the said would be done before I could collect the van and am not getting a response from them.
I didn't say you were. If they fail to supply the MOT in a reasonable time then you would be entitled to ask for your deposit back. But if they do, and you refuse to go through with the purchase, you are then in breach.
I assume you can prove that they agreed to supply an MOT, or is this all just a verbal agreement? What does your receipt/bill of sale say?

  • When buying any vehicle it's always advisable to get an independent inspection. I've used clickmechanic a number of times and have been very impressed. On at least one occasion the inspecting mechanic subtly warned me off from buying a £7000 car that would have cost me dear.

if you do pay by credit card in the hope of getting s75 protection make sure all the business names match up (eg purchase invoice, card receipt etc)

There's not many dealers out there that will accept full payment via credit card.

You don't need to pay the full amount on a card a penny will do as long as the van is between £100 and £30,000 Section 75 would apply. If he's bought it as a consumer.

S75 applies to individuals, not just consumers. So it would cover a sole trader but not a limited company
You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride

The van was advertised with a 12 month MOT (I have taken a screenshot it in case they argue this) They were going to let us buy and drive it away until we pointed out the advert said 12 months MOT.

So why on earth did you then pay a deposit on a van from such an obviously shady supplier?
However, it's quite normal for the MOT to be done only once the sale has been agreed, otherwise the van is sitting unsold on the forecourt with an MOT expiring day by day.
You agreed to purchase last Thursday, it's now Tuesday. So they've had 2 full working days to arrange the MOT: perhaps you're being a bit unreasonable in your expectations, since no actual date for collection was agreed?

    It's usually down to price.
Van prices are at a historical high and demand is through the roof. No dealer needs to discount a nice van.
There are nice vans out there being sold by good dealers, but people would rather get a bargain but in this climate, there are no bargains to be had.
