Q: Tell us how your mum inspires you
M&S Mother’s Day on Heart, March 2021 – Specific Rules.
1.
The M&S Mother’s Day promotion (‘Promotion’) is organised by
Global (as defined in the General Terms and Conditions). The Promotion
will run from 01/03/2021 to 14/03/2021 on Heart Network. Global is the
Promoter. The ‘Promotion Partner’ mentioned in these Specific Rules is
Marks & Spencer. The ‘Prize Provider’ is The NDL Group.
2. IMPORTANT: The Promotion is subject to these Specific Rules and the General Terms and Conditions which are available here. Entry into the Promotion constitutes acceptance of these Specific Rules and the General Terms and Conditions.
Details of the Promotion:
3. To enter the Promotion, you must:
a. go online to the Promotion entry page at heart.co.uk and register your details;
b. explain in 500 characters or less why your Mum (or Mother figure) inspires you.

Entries will be judged by a panel of judges including one independent
judge on the following criteria: The entry should be relevant to the
promotion, positive, feel-good, appropriate for Heart’s family audience
and the entrant should be worthy of being awarded the prize.
5.
Entries deemed by us to be rude, offensive, defamatory, illegal or
condoning dangerous behaviour will be removed from the Promotion.
6.
Online entry will open at 00.01 on 1st March 2021 and close at 2359 on
14th March 2021. Entries received before or after this time will not be
included in the Promotion.
7. During the promotion, winners will be chosen via two routes.

At 10.00am on 3rd March, 4th March, 5th March, 8th March and 9th
March, all eligible entries received up to that point will be entered
into a draw. On each occasion, 50 entries will be selected at random
and will be reviewed by the judges against the criteria outlined above.
One entry will be selected as a winning entry and such winning entrant
will be contacted by one of our representatives via the telephone number
given as part of the entry.
9. If you are this entrant, you and
your Mum/mother figure mentioned in your entry may be asked to have a
call with a presenter. That call will either be broadcast live or
pre-recorded for future broadcast. You must answer your telephone when
we contact you. Someone else cannot answer the phone, participate or
accept a prize on your behalf. If: (i) you fail to answer the phone;
(ii) someone else answers the phone; (iii) the call goes to voicemail;
(iv) the call becomes disconnected; (v) you are not (or do not seem to
us to be) in a position to safely and/or lawfully take or remain on the
call (for example, if you are or seem to be driving); or (vi) you are
not audible or intelligible or we are not able to conduct a
conversation with you in a manner that is suitable for
broadcast for any reason beyond our control (including, but not limited
to: low/no signal on your device, a call is dropped by any network, you
are travelling, there is too much background noise or feedback, etc.);
before or during the Promotion, you may be disqualified and we reserve
the right to select another entrant to participate in the Promotion or
withdraw the prize and select another winner, as applicable. If you
have complied with all applicable terms and conditions, and if you are
successful (including correctly answering any questions and/or
successfully completing any tasks, as applicable) then you will be
declared the winner of the Promotion.
10. A 6th & final
winner will be chosen within 14 days of the closing time of the
Promotion. At that point, all eligible entries for the entire
competition will be entered into a draw. One entry will be selected at
random and the winning entrant will be contacted by one of our
representatives via email or telephone. If such winner does not respond
within 28 days from being contacted, they will forfeit their right to
the prize and we shall be entitled to select another winner by another
random draw. That subsequent winner must respond to the notification
email within 28 days of the date on which they are notified, or they
will also forfeit the prize.
11. An entrant can only be selected as a winner once during the promotion.

By submitting your entry to this Promotion, you confirm that you have
obtained the consent of all individuals that feature in your submission
(in the case of children under the age of 18, you have obtained the
consent of the child’s parent/guardian) and agree to notify us
immediately if their consent is withdrawn at any time.
13. We and
the prize provider and the Promotion Partner may publish and publicise
your submission, name, your nearest geographical location (for example,
your nearest city, town or county), and we may refer to your Mum/Mother
figure’s association with the Promotion and/or the prize, in any and all
media, worldwide, in perpetuity, for publicity and PR purposes solely
in connection with the Promotion.
14. In relation to winners (and
runners up if applicable), you understand that we and our Promotion
Partners may: (i) interview you and your guest(s)/travel companion(s)
which we may film, photograph and/or record and; (ii) film, photograph
and/or record, you and your guest(s)/travel companion(s) in connection
with the Promotion, either by telephone or in person, and we may use
such films, recordings and/or photographs for publicity and PR purposes
in any and all media, worldwide, as often and for as long as we consider
appropriate or desirable, in connection with the Promotion. We may also
publish your and your guest(s)/travel companion(s) name, image, social
media handle and/or profile picture.
Eligibility:
15. The Promotion is only open to residents of the UK aged 18 and over, and who are based in the UK at the time of entry.
16. Entry is restricted to one entry per person; duplicate entries will be excluded from the Promotion.
Prize:
17. Six winning entrants will each receive £2,000 M&S Gift card and a Luxury Spa Break for two people.
18. The prize includes:
a. 2x £1,000 M&S e-gift cards (for the entrant and their Mum/mother figure.)
b.
Spa Break for 2 including: travel allowance for travel to your chosen
spa location, overnight accommodation at the winner’s choice of 4-star
spa hotel. Locations include: Cheshire, Gloucester, Norfolk, Oxford,
Winchester, Yorkshire & Northumberland.
c. Breakfast in the hotel restaurant for 2 people.
d. Spa day experience for 2 people. Including: Access to the spa facilities and a choice of one 50-minute spa treatment.
e. Dinner at the hotel restaurant for 2 people.
Specific Prize Terms & Conditions:

Your prize is subject to availability at the discretion of NDL Travel
and excludes bank holidays, Valentine’s day/weekend and school holiday
periods, specifically the Christmas holidays, summer holidays, spring
and autumn half terms and Easter.
g. Your prize includes a petrol
allowance so you can travel to the prize location. The allowance covers a
round trip of a maximum 300 miles. If you live further than this from
the prize location, the petrol allowance will be provided to you as a
contribution towards your travel expenses.
h. You will be staying
in a 4* Q hotel, sharing a double room with en-suite bathroom on a bed
and breakfast basis. If you’d prefer a twin room, we will do what we can
to secure this for you, but it cannot be guaranteed.
i. 50 minute
spa treatments differ at each spa location but include massages,
facials, scrubs and nail treatments. Treatments are subject to change
and availability at the time of booking. Some treatments may not be
suitable for people with certain medical conditions and will be
substituted for a safe alternative should this be the case.
j.
Your dinner will be provided in the form of a £28 per guest dinner
allowance which will be given to you in the restaurant. Any costs
incurred above this amount will need to be settled with the hotel
directly.
k. M&S e-gift card will be delivered to the winner’s
email address. M&S e-gift cards are valid for 24 months from date
of issue.
l. Prize must be claimed and booked by the winner within 12 months from the date of our initial correspondence with them.
19.
Any other costs and expenses which are not specifically included in
the prize description are excluded and will be the sole responsibility
of the winner. By way of example, without limitation, travel insurance
is not included within the prize.
20. The prize is non-transferable.
21. We reserve the right to substitute the prize with another prize of equal or greater value at our absolute discretion.

Data Protection:

Your personal data, and the personal data of any guest(s)/travel
companion(s) that you or they provide to us, will be collected and
processed by us, our licensees (including Communicorp UK Limited and
Quidem Limited), as well as the prize providers, and if applicable, our
service providers, network operators and suppliers in order to
administer and fulfil the Promotion. Your personal data may also be
disclosed to the Phone-paid Services Authority, Ofcom and/or the
Advertising Standards Authority at their reasonable request for
regulatory purposes, for example, in order to prevent, investigate and
detect crime, fraud or anti-social behaviour and comply with law
enforcement agencies and applicable advertising codes.
24. We may hold your personal data for a period of 2 years in order to comply with our regulatory obligations.

You may be asked if you want to opt-in to marketing from us or our
Promotional Partners when you enter a Promotion. If you choose to
opt-in, we and/or our Promotional Partners (as applicable) will use your
personal data for marketing purposes (see our Privacy Policy for more
details). You can opt out at any time.
26. We, the Promotion
Partners and the prize providers may transfer and process personal data
outside of the EEA and UK for the purposes of administering the
Promotion.
27. By entering a Promotion, you acknowledge that any
personal data provided by you in connection with the Promotion will be
processed as set out above and in accordance with our Privacy Policy,
which sets out full details of how we process personal data and how you
can exercise your rights as a data subject. Please ensure you have read
and understood our Privacy Policy before entering any Promotion.
28.
You may request the removal of your personal details from our
database by contacting privacy@global.com. If you request that your
personal details be removed prior to the conclusion of a Promotion, you
will forfeit your right to enter the Promotion and/or claim any prize
and we reserve the right to select another entrant to participate in the
Promotion or withdraw the prize and select another winner, as
applicable.
29. If you are required to submit a guest(s)/travel
companion(s) personal data to enter a Promotion, you must ensure that
your guest(s)/travel companion(s) have given you consent to provide us
with their personal data.
