Planning Permission

Last post from me on here today but : 
Got a slightly complicated situation with my neighbour and a balcony, I'm going to have to try and object to an application. I'm thinking that if it gets through, and then they realise how much its going to cost to do the work that they decide not to - can they withdraw it? I know its valid for 3 years - i was hopeing to sell in 7 months but with this I'm not going to be able to do so until its resolved. I know an old application will come up but if its been denied, that's ok - but if its still sitting there approved for 3 years - i dont know anyone who would go ahead with a sale with something like that being present - anyone got any ideas on that?

    They can withdraw the application before it's granted, but I'm not aware of any way of a consent being "withdrawn" by the applicant after it's been issued.
  • You get consent and it just lapses if you don't do the work.
    You don't cancel it if you don't do it.
     Most people would have had estimates and sorted out funding  before putting in planning.

    If there is something so wrong with your neighbours proposal that it would make your house unsellable, then that sounds like a valid objection to his planning application.
    Make sure your objection objects to if on valid planning grounds like overlooking, research what the requirements are so you can state a planning policy that it breaches.  It's no good just saying you don't like it, you have to state where it fails the planning guidelines.

    With permitted development available for many building project having to go to the costs involved in drawings up plans ( £500+) and applying for planning permission I doubt the neighbours have done this on a whim.
    You talk about a balcony so first floor level and overlooking your garden ?
    Maybe speak to your local planning department or read up on planning law.

    No research has been done on cost or anything like that - some drawings have been done in terms of how it might look - its currently a felt pitched roof.  I've paid for a surveyor as i want to know what's what going forward - he said the whole roof would need to be re-constructed and possibly steel down onto the ground floor to support a new roof, I'm getting a report - but he advised against it and there's issues with this sort of thing, drainage etc..  I don't think I should be paying to find this out, but again i want to be on top of things, as I'm looking to sell in 7 months...

    None of it is relevant to whether your neighbours get planning permission though, so it's wasted money at the moment.  

    If it is approved and there is party wall issue (you have already posted about this issue on another thread) with your upstairs neighbours, then they will have to pay for that surveyor. 

    Is the space demised to their lease? 

    Does this balcony overlook a private garden of yours or is it simply over your roof?

    Getting the lease looked at, although she has a window there - the balcony would be covering the whole kitchen roof (currently felt pitched roof) so to me feels more over-hanging than people looking out from a window, ovbiously a permanent structure.  Yeah have posted about this, just trying to get all my ducks in a row - as think i have valid concerns which have been confirmed by a surveyor

    That's only if they don't start the work.  If they do, then it's there for a lot longer!
