Estate agents contract

We are very unhappy with our current estate agent (very long story)
we asked advice from another agent who said he would be willing to take us on at the end of our existing contract. As I was unsure of the date I showed him the contract and he informed me that is was actually void as I had signed the contract and not my husband (house in his name), so legally we could swap now.

When I spoke to current agent they are saying it is legal as I sent them ID for my husband (don’t remember doing that) and that they was keeping us to the contract.
Question is who’s right and who’s wrong?

We can't tell you without seeing ALL the paperwork. Only way to know 4 sure is in court (when agent sues you for % commission after you went with someone else).
They might sue just you (as you signed).

What involvement has your husband had with the estate agent? I suspect it may be difficult for him to claim that he was unaware of there being a contract.0

How long is the contract minimum term?What date did it start?What is the notice period?Unless it involves waiting several months, would it not be easier just to wait out the current contract and then switch? It can't be much longer to wait can it?1
