Planning Permission before Building regs

HI all - i've got a situation with me neighbour - she wants to put a balcony above my kitchen - which i don't want.  She has documents for planning permission, but these don't have any reference to how it would be done (roof would need to be completely restructured) as from what i understand this comes with building regulations.  I dont think its going to be possible, but if i want to sell planning permission is valid for 3 years so I'll have that attached to the sale - so I'm objecting to the PP - this seems a bit odd to me, surely the way would be to do everything together ?

    No, pretty normal to get planning first, as that's the thing which you might never get, whereas building regulations is more of a formality.
  • Spoke to a friend whose a builder and he said to get it to work, you'd need steel down the outside of my house to support new decking - i would think this would need to come up in the planning permission bit no?

    Are you in flats?

    She's applied for PP, or been granted it? Does she have the freeholder's permission?

    If her PP application has been granted, did you lodge an objection to it?

    BR checks that the work is being done properly as it progresses. It's not solely an "in advance, I'd like to do this" paperwork thing like PP is. The builders will need to produce structural drawings and calculations, and the BR inspector will check that what's been built conforms to those.

    Ah ok - shes about to and yes will object due to various reasons - were all part of lease...its going to get uncomfortable i think...time to sell once its resolved
    Yeah flats and the baloney would be on top of my kitchen...

    A Building Control application costs money and will usually also involved a report by a structural engineer (sounds almost definite in this case).  All this could cost around £1000 so it is rarely done before PP has been granted - what would be the point?

    PP is more concerned with the acceptability and appearance of the proposed development, BC is more concerned with things being built safely and according to the prevailing regulations.  In this case, there may be a number of options of how to build the proposed structure and those details would be determined with BC and a structural engineer.

    Permission of the freeholder is more akin to PP than BC and as above it would be a risk to embark on a BC application without the freeholder's consent.
