    It's not really 50/50 though, is it? You emerged into moving traffic, so to speak. The other driver should maybe have noticed your reverse lights, yes but you were the one coming out of a space and should have looked to see if anyone was coming before you did so. I know it's easy to talk and I do admit that I've had a couple of near misses myself when reversing from a parking spot but the onus is on the one joining traffic rather than the one just passing by.

    If you were reversing at the time then its your fault.

    If you say you were stationary and the TP says you were still moving and neither party has evidence then it may go 50/50. Where the damage is to the TP vehicle may support their version of events.

    As you will be at least 50% to blame then the question is less about if its worth you claiming for your damage but more about if the TP is intending to claim for theirs. If they do then your insurers will be making a payout anyway in which case there will be no difference if their outlay is 50% of the TP claim only or your damages plus the TP's.

    They don’t mean in terms of looking backwards for reversing - they mean for recording incidents like this for claims.
