Financial Ombusman

I have just received an email from the Financial Ombudsman.  They are not supporting my case.  They have taken 16 months but if I am not happy I must reply within 6 days!  Are they having a laugh?

    I suspect they have too many cases to waste time laughing at your particular case.

    Do you mean they are no upholding your case? IE they have ruled against you?

    Assuming this was the initial negotiator/adjudicator's decision you have the right to request the case to be escalated to an ombudsman for their opinion.

    If you are unable to reply in full within 6 days, why not send them a holding reply to politely advise them of the date by which you are able to reply in full. Though in the interest of not having your case delayed further, you may choose to respond in full.

    Also if I were you, I wouldn't be asking them whether they are having a laugh etc.

    Probably due to their operating year finishing at the end of March, so they seem to be trying to get as many cases resolved before then. If you're not satisfied with their conclusions and you have genuine reason to feel the complaint should go further, then just ask for it to be escalated to an ombudsman. You should then have a further chance (and more time) to provide any input as to why you believe their view should be reconsidered.

    I have a case one and a half years old:The Case handler suddenly disappeared in December 2024 just as I had provided a Consultant Engineers: report 
    This confirmed the fraudulent charges by a Classic Car specialist maintenance company:: The report advised criminal prosecution against the company:
    The new case handler after having the report for SEVEN MONTHS IGNORED IT:  The assessment read the offer of £1200 was fair: The report cost £750 : Section 75 did not act with due diligence and the assessment read like a damage limitation exercise for Nationwide: Full of inaccuracies not even addressing the vat due or interest:
    So now to an Ombudsman for a third try:
    I don’t think the Financial Ombudsman is fit for purpose and offers no support for consumers:

    FOS can only consider complaints about regulated services, so it should not be surprising if they will only consider evidence related to the fairness of Nationwide's actions or inactions, given what was known at the time. Compensation would not include specialist reports you have elected to commission at your own cost. What was the reason for obtaining the report? Are you considering taking the maintenance company to court?
    A S75 claim against Nationwide would entitle you to a refund of the charges for services that you did not receive or were significantly not as described. It would include VAT charged when the services were paid for, but it would not include interest on your credit card from the borrowings. Generally it would be supported by an invoice with a total price paid. You could include interest in a complaint about failure to refund, but I don't think it would normally be included in a S75 claim itself.
    If you get an Ombudsman decision, it would be interesting for us to review the DRN to understand the detailed reasons for the offer of £1,200.
