Credit Hire Court Summons - Experiences?

My husband got a bill from an AMC for 12k and he’s prepared to go to court as he didn’t need the car and told the company over the phone after a couple of days that he has made other arrangements however the AMC insisted for him to have a vehicle. Later on they asked for all financial information and he didn’t want to provide this information so they issue him with 12k bill. His argument is that he declined the car but they insisted for him to have this hire vehicle. Has anyone been through similar experience and is it more likely that the company will loose on misinterpretation grounds? Any suggestions or advice is highly appreciated.

    My advice - get a lawyer.
    Don't assume the accident management company will lose.  Your husband may have done everything wrong - including not reading the contract.
    If it sticks, force it.
    If it breaks, well it wasn't working right anyway.

    AMC is Accident Management Company?
    If so, then someones car insurance will be covering it and you should refer it to your insurer. They deal with this all the time.

    Except they won't...

    The other insurer will be refusing to pay what they see as a massively inflated claim, and a failure to mitigate losses. £12k in car hire for a car that wasn't needed is ridiculous. The financial information is required so they can prove that he couldn't have organised alternative transport himself. It's all in the Ts & Cs he will have signed.

    I suspect the case will come down to how hard the OP's husband tried to get them to collect the car.

    I think you’re missing the point here. The AMC are going after the OP’s husband personally for the cost of hire because he won’t play ball and help them pursue the third party.

    As the value is over 12K this is likely to be on the "Fast Track"  rather than the "Small claims track" (where costs are strictly limited) and on this track the losing part can be made to pay a set amount of the other sides legal costs.
    However if your lucky it may well be allocated to the small claims track
    Have you had a letter before claim yet?, if not dont worry yet.  Legal beagles is a good forum for this kind of thing.
