PCN Holiday Inn Parking Eye

King

I received an email on 19th Feb 21 from the leasing company which our business leases a vehicle, informing that they'd recieved a PCN for our vehicle.
A letter has also been sent out, but as of yet hasn't arrived, the email from the leasing company states this could take up to 30 days.
The evidence on parking eye notes a stay duration of 10 minutes.
The trip in question was a drive by of a local gym on 6th Feb 21 which happens to be behind the Holiday Inn but shares the same car park entrance.
My question is, is it wise to wait for the letter to arrive before lodging an appeal?
From the Newbie thread it seems this action and possibly the section about lease cars would be the next step to take.
--------------------------------------------
Postal PCN from a BPA or IPC member? (i.e. with no mention of any windscreen ticket):
A postal PCN or NTK might be headed up 'Reminder' or 'Charge Notice' or it may even be a letter from a debt collector - it is your Notice to Keeper, in effect, if it's the first letter to arrive. No need to wait, appeal online as registered keeper (or as ''hirer/lessee'' if that's the case, see * below re lease/hire cars).
---------------------------------------------
Many thanks in advance.

What you want to do is avoid the leasing company paying the speculative invoice on your behalf and charging you an admin fee for doing so. Tell them they must not pay it but they should fill in the transfer of liability slip and name you as hirer/lessee (NOT driver) and them you will receive a NTH in your name, which can be dealt with by you. Meantime complain to Hotel and gym as they have obviously a problem with their ANPR cameras.4

Absolutely do as advised above, and don't hang about. You do not want the lease company to pay this and then charge you. Check if they are a member of the BVRLA, because that trade association has told its members not to pay and not to pass on the charge.
Have a good look at your lease agreement to see what it says about scamvoices from unregulated parking scammers. Not that they are not an authority and cannot issue penalties or fines.I married my cousin. Thank you both. It looks like the leasing company has transfered the liability according to this line taken from the email.
"Arval are unable to liaise with the authority regarding the offence once the liability has beentransferred due to data protection"
They have issued an admin charge of £12.50 +VAT which it looks unlikely to be able to reclaim"Arval will only look to refund the administration fee if you have successfully appealed your fine due to the authority having issued it in error. You will need to provide us with proof of this from the authority admitting their mistake, and upon receipt of this we will credit the administration fee. We will not look to refund the administration fee if your appeal was successful and cancelled as a gesture of goodwill."
Having re-read the email, this line makes me think I do need to contact them to re-itterate they fully transfer everything to my company."If you ignore the fine and not pay it Arval will receive an escalation notice and we will pay the fine
and recharge the cost to you to avoid any further escalation or legal proceedings."0 -
Why on earth would they pay - they admit they have transferred liabiltiy
What does the T*C say aboiut INVOICES from PRIVATE entities? NOT an "authority". PE have ZERO "authority".2 -
None of that is relevant to a scamvoice from an unregulated parking scammer. It is not a fine from an authority so that section does not apply, which is why you need to check what it says about scamvoices.
The BVRLA allows an admin charge for transferring liability to a hirer/lessee, but the admin charge above does not cover this situation.
If there is no specific mention of an admin charge for scamvoices, then you can challenge that because it is not a part of your legally binding lease contract.

You are reading the wrong part of the NEWBIES appeal section (first post) and need to read the bit lower down about hired/leased/company cars and the special appeal wording by Edna Basher. And yes you will be waiting to get your NTH first.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
