    This is how I understand the problem to be. Its for getting their bins from their back garden, not for storing stuff in the garage and walking across a private drive to access from the front.
    It looks like there is a  gate on it at the road end,  personally I would move it to level with  the front of your house.

    You are correct, that exactly where the fence has been erected.

    Hi Frogglet, that’s a good question, I’m not sure to be honest but that’s where my car gets parked as it outside my front door. 

    The yellow line added is where the fence has been erected and the footpath in question does run down the side of my house. 

    Access to my garage is via my driveway, access to plot 464 garage is via the other close along with plot 463 (shared driveway)

    So you are parking in what looks like, by the layout of the road, part of a turning point rather than an actual parking space.

    No choice, five pages in and no one knows what the blacked out area is and a yellow line shows where the fence is. Can I be bothered to scroll back to look for where this is?, from memory there are two yellow lines.
    I suspect the lack of clarity is because the op doesnt want to give up areas they use as their own.

    In fact, revisiting the plans, contrary to what the OP thinks, the general public have probably got a right to use all the general footpaths on the estate, even the one that links to the area of road that the OP blocks with their car.

  • This is fun. I have to admit in my first post I thought the fence was on the path running up the side of the OP's garden.

    Given it's actually on the OP's front drive (for lack of a better description), then there aren't any land ownership issues with the fence. But given the various colourings and markings on the plan, I'm willing to bet that 464 has a right of way over that area at the front of the houses. THAT is what needs clarifying now.

    Anyway my answer to the original section stands - you can repair the side path using your ancillary right of repair to your easement.

    Its the section of footpath between the blue markers that you wish to maintain, but you down know who the owner is.
    Does 464's title include a right of way along the route blocked by the new fence? I don't think we've been told the answer to that.
