Cca capquest and a host of creditors

Hello I am in a never ending circuit trying to obtain my Cca. I wrote to NCo Europe as to obtain my Cca in November. I eventually had a letter back from them stating that my query had be submitted to Capquest the legal owners. I then had a letter from Capquest in December putting things on hold and stating they were writing to SAV credit Azzurro to obtain the requested Cca. I finally had a letter from Capquest stating that the client failed to respond and the request for the statement is closed. Contact them to discuss further. I prefer email. I eventually got a response telling me to contact. You guessed it NCo Europe. Its obvious no Cca is forthcoming an I have some advice. I attach last email.

    Best off posting in debt section. 
    As it looks like you are trying to get out of paying a debt due to card co unable to provide your signed agreement.

    CCA requests should always be done over letter with the £1 postal order and its best to keep letters for these contacts too. 

    If they don't provide the CCA the account and collections should stop until they provide it, that email seems to state that the client doesn't have the agreement, so they'd be unable to enforce court action without it.
  • most requests for cca where they cant supply the cca they simply say they cant find it at the moment and meanwhile the debt is unenforceable. That response above looks like they are admitting they cant find it but are trying to hide the fact that its unenforceable, until if and when they do.

    You have made a valid request for information pertaining to your credit agreement.
    The company has not responded to you in a timely fashion, but that makes no difference whatsoever, your account remains unenforceable now until they do provide what you have asked for, however long that may be.

    So that is now a valid defence against any court claim.
