    hi all,

    a couple of questions on the DQ; Mediation, i know it says to answer no but i am just thinking in order to end all of this I would probably pay the initial parking fee, is there any chance they would go for that? your advice.

    secondly can someone detail me the court fees, will i actually have to pay something?? confused on this part?

    1) very unlikely , more chance of you winning Euromillions with one ticket

    2) Court fees for one £100  PCN are typically

    £25 CCBC fee
    £25 court filing fee

    £50 legal fees

    Add £100 PCN to that and you get a typical loss in court of £200 , or less

    But it is worth remembering that you only have to pay court fees if you lose.

    As you are planning on winning, there will be no fees to pay and you could walk out with (admittedly limited) costs awarded to you - to be paid to you by the Claimant.

    Yes, you do realise a Defendant pays no court fees?!

    You just mean if you lose (unlikely) which is the only time some small fees that the Claimant paid, can be ordered back.


    There is no risk, stop wobbling/going against our CLEAR advice to utterly avoid the horrific experience of being bullied and made to feel hopeless and small by a Court Mediator, making you feel (wrongly) that you have no case and must settle for a 3 figure sum.  DON'T put yourself through that. 

    Stop getting cold feet!   A telephone hearing with a Judge is miles fairer and more preferable than half an hour with Mediation Mary:

    See what you are up against? 'Mary' the Mediator who wanted him to just give up. 

    Now compare that to his actual hearing, with a friendly Judge who dismissed the claim and gave HIM £111 costs:

    Do you have pictures of the signs yet, showing that ther is pay by phone OR pay by app available?
    You need to work out how you are going to show why you called a number, ideally 
  • Ok guys, need your advice. Court hearing coming up very soon. They have offered a discounted rate of £150 to end the case (from circa £240), i know a rip off. Simply put these are the facts. car park entry 2:55, exit 3:18. The only way to pay on the day was via the machine, cash ONLY. There was a queue ahead of us, seemingly all trying to pay, so this took some time to get to the front (in context of the pandemic), when we got to the machine, we realised cash only no card being accepted. We called the number displayed (paybyphone) at 3:06 and 3.09 each lasting 2 minutes but could not pay. I have itemised billing showing the call. Then a different number (which i think was also displayed on the machine) this one leads to Britannia parking at 3:11 which lasted for 6 minutes. After a long wait, they basically told us we cant pay on phone, app or card at the machine so we left straight after the call which coincides with the exit time. To date I have no photos of the pay&display machine to verify the numbers called are those related to the car park but if you call these numbers they direct to parties i mentioned. In short do I stand a chance???

    Yes, you list great evidence there, that you were unable to accept the contract, therefore left without agreeing.  No contract, no cause of action.
